Which is the best way to proceed?

My aunt wanted to sponsor her sister to U.S so she filed an I-130 for her sister family (4 people) since 2006 and she got a notice recently stating that her application has been approved and forward to NVC. However, she also now want to file a different application for her brother. My questions are:

Is it better (or wise) for her to file 2 different I-130 applications for sibling at 2 different times (2006 and 2010)? Or it is possible to file a request for adding more people onto her pending application?
If file 2 different I-130 applications at 2 different time, would it by any mean affect the chance of getting approval from the US consulates in my native country?

Please advise. Thank you very much.

For every sibling you have to file seperate petition, you can only add a child born to the sibling petitioned after its filed at the time when a visa number is available (10-11 Years), a lot more for Phillipines, China and Mexico.
For Siblings it is taking about 10-11 Years after filing the petition to get a Immigrant visa.
If she files for here brother now it will take 10-11 years from now to finally get the IV.

Thank you very much for the reply. What I worry is which would be a better way to do between filing two separate petitions at 2 seperate times and wait until 1 petition is completed then file another? Some people told me having 2 pending petitions at the same time with NVC may affect the chance of getting any one of them completed. Is this true at all??

Once again, thank you very much for your reply.

As long as she meets the financial requirements she can sponsor as many families as she wants at the same time. She really needs to understand the support obligations.

The OP has asked question about filing Multiple petitions at the same time not about I-864 or support issue, for all we know the OP or even the beneficiary of the petitioner has sufficient assets to qualify.

So to answer your question, Yes she can file multiple petitions without having a negative impact on the other at all. Don't even worry about the support issue as only God knows what the Law would be 10 years after their Visa number becomes current.

Most important aspect is to file a petition for a qualified relative, don't get side swiped by secondary issues as Support at this point.

If one is unlikely to be able to meet the support requirements, effort is better spent helping sibling qualify for guest worker to employer sponsored GC where sister's ability to supply affidavit of support is not required.

It would be devastating to all to reach priority date and be unable to meet the sponsorship requirements.

Think worst case and long term.

Thanks. She makes more than double the finacial requirement for 2 families (8 members) so I am pretty sure she would have no problem with the obligations. What we worried is that whether it is safe to file a second petition while the first one is still pending. I guess from everyone's reply on here that it is okay to do so. I would advise her to get on with the second petition then. Thank everybody very much for your assistance.

Remember she has to count all in her household as well as all in both sponsored families.

Also, a person qualifying for an employer sponsored GC is able to live in the US during processing wait. They can then use whichever petition (family or employer ) comes up first.
