Hey guys,

I am an U.S. citizen and resident of New York State. My wife and me are
currently live in West Virginia and attending a college. I will start her Green Card application soon. But we are not sure whether we should send the application to the immigration office in New York State or to the one in West Virginia. Besides, is it possible to file I-130, EAD request, and Advance Parole at the same time before filing I-485? Can she get her EAD and Advance Parole before filing I-485 and other documents? I want to get her EAD and Advance Parole first, then worry about AOS. Anyone can help me out? Thanks a lot

you send all at once (130, 485, 175-EAD, 131) . you file the 485 along with 130 because she will immediately get an alien number which is what you need for 485, so that is why they have you file at same time. After you file, there is fingerprinting and then shortly after that you get EAD and then an interview and then permanent resident status, so the AOS stuff just come later anyways. you have to send everything to their Chicago address first and from there your stuff is dispersed to other agencies based on where you live. make sure you look at all the required documentation for the papers-for the 485 your wife has to get a medical exam by a specific doctor, etc. if you don't send in all docs it will delay your case and will most definitely delay the EAD. good luck

Thanks man. By the way, when is the right time to submit I-864 (affidavit of support)? Is it required before issuing her EAD or Advance Parole or I can submit it later after she obtain her EAD?

yes submit the support doc with the 485- if you don't send the stuff it can delay your case. another goof piece of advice is to, if you can afford it is to have an immigration lawyer do your papers-or you can fill them in and have the lawyer check-this is a great forum though to get the help without a lawyer.
