Time is passing by but not seeing much 140 approvals, especially EB2’s. Nothing is moving on EB2. What's going on????? :(

 After 1 month they will say its vacation time and come in January and slowly open those files. Man this is terrible. So is this mean we have to look for February 2005 now?????

 I wish there was some rule to say, if 140 if filed and passed 180 days, you cannot reject 140 in any case.
If there are any information required it should be asked before the 180 days only.

Is there any way, we can push them to look our cases, is there some way on this earth.
God help us.

dude there are lot of people with 140 filed in 2003 and still pending.

Friend,
I do not ignore that at all.
Imagine a queue for tickets in cinema theater, you are definitely before me, but I am back and asking the line to move, that’s it.
If it move/approves for you, I can get some hope. That’s it. I am some body back of line and just shouting for line to move.
Best of luck and hope your approval will come soon and give others hope.

Hritik,

Is your FP done ?? i didn't see you in the 2003 tracker ? If your FP is done you are a likely case for concurrent approval of 140 and 485 !!

when i contacted congressman regarding my 140, they got back to me saying that currently INS is processing Sep'02 cases (I GUESS 485 processing date) and i have to wait for my turn.

So far i was hoping i could get some answer from INS if i go through Senator/Congressman. But they proved it as a wrong assumption and which is true.

I told the Congressman that people who had filed after me got approved and there is a difference between 140 & 485 applns. But he says that INS is considering both applns as one ...

Anybody succeeded contacting Senator/Congressman?? I strongly feel that don't keep much hope on them. they are useless too like INS :(

I have not seen any 140 approvals recently, and i'm starting to wonder if they are strictly following the Fujie memo or something (forgot the name)

Anybody from 2003 got their 140 approved in the past one month or so?

If so, please post the details and it may give some hope for ppl like me.

I can't agree more. I've contacted both senators and congressman, hoping they could do something. It turned out their working ethnics is the same. So disappointing.

I am in california and i've contacted both me representitves and senators. Both Senators gave me standard emails that did not help. The representitive did help us to issue inquiry into CSC. CSC responded saying that "they are working very hard to reduce the backlogs", which did not help either.

I called to the person handling immigration issue in the representitive's office, asking her to issue another inquiry about AC21 applicibility to pening I140/485 for more than 180 days. She told me that they had talked to CSC many times and the answer is always "I140 has to be approved before AC21 can apply". I was disappointed that she stands more on the goverment side more than our side. She said the pilot program is for the CIS to improve the service, so in the long run everybody will benefit.

I was on the phone with her for more than 20 minutes. She eventually agrees to issue another inquiry into CSC for more cleraification on AC21 applicibility of pening I140/485, as a curtesy.

The problem, though, is that this is burning issue for us. I understand CIS may eventually improve, by having to launch the unfair pilot program, but we may be losing the entire three year green card processes as soon as tomorrow!

sign, this is my ecperience with our representitive so far. hope this helps.

by the way, my I140 hasn't gotten processed by contacting them though.

I am thinking contacting John Kerry may help more.

Don't waste your time contacting John Kerry. I'm in the Boston area and I had such bad experience with him/his staff already. First, I sent email and regular mail to his office, didn't get reply. Then I called the office, the lady responsilbe for immigration issues is called Carmen. She never returned my call after leaving her so many messages. Finally, I drove a whole hour to the office and was stopped at the gate of the building. Reason? Because I don't have an appointment. But how can I make an appointment. Everytime I called, I was transfered to Carmen's voice mail and she never picked up the phone! I had no choice but to leave my information again, hoping she had some mercy to contact me. I would be so surprised if she call me some day.
Wish you good luck! If you can get any help from John Kerry, please let me know.

Once they stopped doing H1B revalidations in US, I thought those resource will be used toward the Green card processing.
May be they are went to early vacation or unable to understand the new changes in laws (Fuiji, AC21 etc), they are getting trained on that.
