I am trying to find the information about the length of waiting time after PD becomes current. My PD is current since May 1. When could I expect to receive a decision? Should I see LUD change(s) before any decisions?

I received an email message from USCIS indicating that a RFE was sent out. Does the USCIS send RFE to applicant or lawyer? Thanks.

My PD became current in May 2007, but I wasn't approved until July.

But you never know when they will approve your case. Some people get approved the first week after their PD becomes current, while others stay unapproved for months and months until retrogression kicks in again.

However, one sign of a likely upcoming approval is if you get your 2nd (or 3rd or higher) fingerprint request when your PD is current or soon to become current.

Received RFE letter today. USCIS asked for two things: one is to submit a completed Form G-325A, the other is to submit documentary evidence confirming that I still have the same job duties of the underlying I-140 petition including letter of employment, publications, grants, memberships, etc. My response must be received within 30days.

Dear fastapproval:

Did you ever go to an Initial Interview at a local immigration office or you just received the RFE?

Best of luck.

No interview, only received the RFE letter. The letter was sent to my attorney. I heard that the family-based applicants are usually requested for an interview, not employment-based applicants, but I am not sure whether this is true or not.

When will I-485 be processed after PD becomes current? - H4 extension is denied today.

My husband's H-4 extension is denied today. The below is the notice from USICS:

"This notice is in reference to the Form I-539, Application to Extend/Change Nonimmigrant Status. It is ordered by the Director, California Service Center, U.S. Citizenship and Immigration Services (USCS) that the application for a change of status be denied because the applicant is statutorily ineligible for the benefit.

Section 248 of the Immigration and Nationality Act, states in pertinent part:

The Attorney General may ... authorize a change from any nonimmigrant classification to any other nonimmigrant classification in the case of any alien lawfully admitted to the United States as a nonimmigrant t who is continuing to maintain that status and who is not inadmissible . . . except in the case of--...

(4) an alien admitted as a nonimmigrant visitor without a visa under section 212(I) or section 217. . . .

USCIS has determined that the applicant was admitted to the United States as a DT, Advanced parole for an Alien with a Pending 485 Application. Since Section 248(4) of the Act prohibits a change of status, the applicant is not eligible to change nonimmigrant status. Accordingly, the application is denied."

My husband's H-4 extension is based on my H-1 which is valid till 2012. He filed H-4 extension before based on my H-1 and every time was approved without any problems. Why his petition got denied this time? anybody know? What is DT?
