When to file for 7th year extension ?

Dear All,

My 6 year limit will be over on 03/07/04. My employer has already filed for my GC labor with priority date in 07/2003. And thus it has been more than 365 days of labor filing. Now while requesting my employer to proceed for filing H1 extension, I have been told that as per law H1 - 7th year extension can be filed during the period between 'less than 90 days and more than 35 days left'.. Is this true? If at all it can be filed now (October 2004), I may need any kind of link which represents 'legal facts' to support my argumnent back to convinve them.. Any help is highly appreciated..

You can apply 7th year extn 6 months before expiry of 6th year.
If at all it can be filed now (October 2004), I may need any kind of link which represents 'legal facts' to support my argumnent back to convinve them.. Any help is highly appreciated..

Thanks for your reply. Yes, you are right.. It was a typo mistake.. 6 yr. limit actually gets over on 03/07/2005.

Apply 7th yr extn (no premium) by 1st week of Nov 2004.
