When to apply for reentry permit

Hello all,

Me and husband got GC in sept 2000. He is getting laid off and we are going back to India.

We would like to apply for reentry permit. Since sept 2000, we have been out of country only once for 5 weeks.

I hear that to process the reentry permit it is taking as much as 1 year and it is valid for 2 years from the date it is approved. Or is it from the date of departure???

in the form I-131(applying reentry permit), they ask you how long you have been out of country.

A......If we apply in 04 MAy and go we will get approximately 3 years(processing time of 1 year plus permit of 2 years). We can mark the box of less than 6 months for out of country box.

B.......If we come back in march 05 and apply in march 05, we can mark the box out of country between 6 months and 1 year box.

My question is does these both scenarios have equal chance of getting reenty pemit for 2 years.?

Basically I am trying to buy more time to come back.

Your suggestions are greatly appreciated.

I have done this reentry headache twice for my father and twice for my mother...

So I am feeling like a pro in this matter...

When you have to apply for reenty permit, you have to be present in USA and you can leave the very next day once you file you application...

There is NO WAY that you will get it in less than 15 months if you file it with Nebraska Service Centre.

The good thing is that you will get it for two years and the starting date will start few days before you receive it. So practically and technically you can stay in India for 3+ years. And, you can get 2 re entry permit for 2 years... after that I do not know....

Rest you will sort the dates out and make sure you ask somebody who is going to receive your reentry permit here in USA to send it to you in India once you get it... so must have it when you come back at US port of entry..

i just cudnt get your question correctly..ca n u elaborate a bit on those options A and B....

I guess if you file in 04 may and wyou willl not going to get it until august september 2005 how will you be able to file another one in march 05......:confused: :confused: :confused: :confused:
 
Reentry time starts from the date your application is approved. The chances of approval depend on ur reason, but its unlikely
a "reasonable" reason will be turned down.

Apply ASAP, check ur online status. Your reentry will surely
take > 1 yr. Approx 9 months after , contact ur senator
or congressman they can get it expedited.

You can ask for reentry to be sent to ur local consulate in india or whereever....

If I don't apply now I will come back with in one year and apply only in march of 05 for the first time. I don't want to expedite the processing of it. Infact the more it delayed the better, only because at this point we don't know how long we are going to be in India(could be anywhere from 2 to 5 or so years).

I understand that reentry permit is valid only for 2 years. So if I apply one year later, I have more or less 4 years to come back. 04 april to 05 march+ apply in mar 05(processing of 1 year)+ reentry permit of 2 years= 4 years.

I hope I make myself clear.

I understand what you are trying to say. I will tell you what my parents did.. even they were trying to buy time.

I will use your date example to make as clear as briefly possible:

Apply April 01, 2004 Fly to India April 15, 2004
You will get the permit in July 2005 (u r still in India)
Somebody in US mail your reentry permit or personally carries it with them(if he/she is travelling) And the validity is from say June 2005 to June 2007....

You can come back anytime before June 2007. If not planned, you can come for a month in April-May 2007 and apply for another one... same story.... here comes 2010.... :cool: :cool:

My point is who has seen even 2007 and if you have very stringent plans that you are not coming back before 5 years.... then whats the big deal if you come back in April-May 2007 and stay in US for couple weeks, visit disneyland :D apply again and go back to India....

But most probably my husband will start working with some Indian company in India. So is there any chance of getting approval for the second time(in 07)?

What date should I put in form I-131 for the question "intended date of coming back to us" ?

Should I mention that the reason for leaving the country is the lay off?

Do you mind telling what reasons did your parents give?

You will get 2 permits for 2 years each.. there should not be problem in getting second time.... don't mention them layoff... tell them you are going to sell your assets in india and transfer to usa(that was what my parents did twice and succedded...maybe it was my top secret plan...hehehehe:p:p)

tell them exact time that you will staying out from usa..if you fill six months you might get for 1 years tell them you need more than 1 year so in you will get for 2 years..
there are 2 denominations of reentry permit to the best of my knowledge 1 or 2 year.. nothing in between..

But what if USCIS backlog isn't any more and they start processing immediately, then I get till april 07 anyway?

My basic question is

A...One person applying with less than 6 months out of country box marked on I-131(applying for the first time)

And

B...One person applying between 6 months to 1 year out of country box marked on I-131(applying for the first time)

Both has equal chances of approval or not?

Bulbuldude...are your parents here after the second time approval?

I dont think A or B will make a difference. Apply ASAP if you are leaving now not March 05. If u leave now and apply in March 05
u will have to come back to the US within 364 days... Just cause u apply does not mean reentry was granted

Reentry & AR11 (Address Change)

Attn. Bulbul, JoeF & Others

Summary -:
I've been outside US since July '01. Got my GC in Jul '02.
Applied for Re-entry the same week & travelled to Europe.
Will make a short trip to the US, next month (2004).

The IRS has my US friend's address.
I've never informed the "INS / Homeland Security" about any address change/AR11 either before, or since my move in 2001.

Question -:
What should I do ? Should I fill out the AR11 form
and use the US address or my address in Europe.
Is this necessary ?
