As mentioned in an earlier posting, I got disabled with a rare disease (with specialized physical therapy available only in US and that too. I in CA) and need constant care for several months. My parents are here to support me but I may need to extend the stay by three - four months until I recover.

With this in mind
a) how soon can I apply for extension? http://www.immihelp.com/visas/extend.html says do not apply within 3 months of arrival. I 539 instuctions however do not say anything. Also, has USCIS ever taken more than 4 - 5 months to process I-539 extension of stay
b) The link at http://www.immigration.com/frame/eprocessingtimecafr.html shows that I 539 processing time is 3 months. Is that correct? I am looking at the row that says 'All other extension applications'. Is that the typical time frame
c) The reason that I am going to provide is ' My son has been temporarily disabled and is receiving specialized medical care available only in US. He is in constant pain. We want to be with him until he is able to live on his own. ' . Any idea if that is acceptable. I have to somehow show that it is not going to take away american healthcare jobs.

Well I need medical care and also someone who can help with daily activities. I am bed ridden most of the time. The extension is for my parents. So that is why the reason starts with 'My son....'

Any inputs appreciated

State the true reason and there needs to be a real justification for an extension. Don't be surprised if they ask for proof of your illness and other records.

My friend's parents had extended their stay a couple of years back as their son was undergoing a major surgery. USCIS has asked for hospital records, physician's letter etc. So you should better be prepared for furnish them.

Be a little careful when you word the justification letter. USCIS may interpret this as your parents taking away the job of a US healthcare worker. I have seen such requests being denied.

Thanks for the advice. I am getting confused. Triple citizen can you please give an indication of what kind of medical situations did you see the requests being denied e.g. were they for pregnancy or were there already some family members in US and extension was sought for more members.

For me it is a matter of life and death since if I don't receive medical treatment, the pain level becomes intolerable. Any idea if I can write to my congress person or try some other way.

Thanks for any help

If it is indeed a matter of life and death, shouldn't you require care from seasoned medical professionals instead of your parents?

Not sure what you are asking here.Well I have been going to doctors. There are no known cures. I have to try several treatments. Can't do it on my own since bedridden (who is gonna drive / who is gonna prepare food ). Medical professionals don't do that. I inquired about nursing homes. They don't admit young people. Not sure what else you have in mind.
