Hi,

Date on GC for PR is 11/18/2004.

When can I send my N-400 application. I know the rule for 90 days. Can I mail my application before 90 days but by the time it will get there it will be less than 90 days. Or what do you suggest when should I mail it. I want to start this process as soon as possible. Also, if I mail it early what date should I put on the N-400, sign date.

Thanks for your help

You ask yourself this question - is your life going dramatically change just because you didn't want to wait for an extra week and applied exactly at 90 days?

Time for processing varies for each person and in the end a week here and there don't make a squat of a difference.

To answer your question - the 90 days is when your application is being entered into the system.

Hotmoose,
Yu can not sent it before. The law says 90 day. Your 90 days will be due in 4 days.
Just be patience, 4 days mean nothing!

I know a case which applicant sent it 4 days earlier than 90 and was received the exact date and whole package was send back. USCIS honors postmark date as filing date so send exactly 90 days before 5 years. Keep in mind that october is 31 day so if I were you I would send it on 11/20/2009 or after just to be safe.

thanks for your response guys.. how about if a send it on 08/20 and overnight..they will get it on 08/21,

thanks for your help

Don't try to time it to the exact date. Sometimes a clerk at USCIS miscounts by one or two days and rejects the application without an interview, causing the applicant to waste a month or more.

Give a buffer of at least 2 or 3 days, making sure that the postmark date and signing date are on or after the 88th day. Sending it on the 20th of this month (which is exactly 90 days) is cutting it too close. Better to send it on or after the 22nd.

Also check out your DO's timeline. If it is very fast your interview date can be
before yoru GC 5 years marutiry date and that may cause rescheduling and rescheduling can delay yoour case up to many months.

Look at it his way : waiting 4 days is not a very long considering it takes several months for the entire process.

File on the 90 days, overnight it so they can received in 89 days..

B,

He just need to wait to be on the safe zone. I read a case where N400 was rejected because the guy was overly excited to file for citizenship. A weird case and based on technicalities, he guy filed before he was eligible. USCIS didn't realize till the interview stage, and they denied the application. The individual was told to file when it was his time to file, which odd enough, he was now eligible when they denied his application. The key in his case was WHEN IT was FILED, NOT when it was ADJUDICATED.

The OP should file on the 90 day, send the paperwork overnight and delivered by 8:30am. UPS offer such service. When it is received, it will be the 89 day for eligibility...:p

hey -- i sent 4 days early and it went thru fine -- ( ups ground takes 4 days to deliver from my area )---

There are some cases applications sent early were not returned but rejected at interview. It depends on whether IOs used recepit date or yoru signature date. You may be confident that it is receipt date that matters but to be on safe side it is better to let signature date be within 90 days

I would suggest date the application as Aug 23rd, then mail the application on Aug 24th by overnight USPS Expressmail for delivery on Aug 25th.

That's my personal opinion.

thanks for responding.. I think I am going to send it on Friday, 21 and they will receive my application on Monday, August 24. I don't there should be any problem with this.

Also, even if I overnight my application and they receive on Friday, 21. I don't think they are going to do much with my application on that day anyways.

This is perfect timing.
