when should i apply TD visa?

In my situation, I am not sure when i should apply TD VISA. Pls give me some advises.

I am a chinese citizen and also a canadian permanent resident. now, my husband gets TN visa working in US. My son and i are planning go to US; however, before that, we need to back to china for spring holiday and then go to US from china directly.

Do I need to apply TD visa at the US consulate in canada before going back china(by the way, my son is a canadian citizen and I have already obtained B2 VISA).

If here is any possible I could land US by using my B2 VISA from China, and then I file I-539 by mail way to apply TD VISA instead going to US consulate in Canada.

Yes, you can use your B2 visa to enter US. In fact, my wife is also a Chinese citizen and she entered US with a B2 visa from China in Feb. As long as your B2 visa allows you to enter US from China, there should not be any problem. You can file I-539 to change your status to TD while you are in US. However, if you ever go outside of US, you may not be able to re-enter US on TD status since you do not have a TD visa. What I did for my wife is I booked her a visa appointment at the US consulate in Vancouver, BC and she got her TD visa there. She then entered US on her TD visa from Canada and she's in TD status now. Hope this helps.
 
Thanks. It's seem like I'd better apply TD visa first. But here is a question that if I get TD visa and I go to China, then I land US from China though TD visa, would it be OK?

However, if you ever go outside of US, you may not be able to re-enter US on TD status since you do not have a TD visa.
This would be true if she left North america. if she only goes to canada, however, for less than a month, AVR would get her back in without new visa.

By the way, for her to enter with a B2 visa, she needs to prove foreign residence, which would not be the case for TD.
 
hi, i just heard from other friend that the processing times of TD VISA vary at each office but most are within a few weeks. My god ! I don't have so much time to wait for it beacuse I have bought the flight ticket. Could anyone tell me the exactly time I need to wait in your experiences? Thanks !
 
My wife got her TD visa on the next business day after her interview at the US consulate in Vancouver. US consulates usually don't give the visa on the same day as your interview any more. They used to. I got my B2 visa immediately after my interview when I applied for it in Vancouver, BC in 1997. I was a Chinese citizen back then. They don't do that any more. However, if you tell them you need to get back to US ASAP, they'll most likely give it to you on the next business day. In my wife's case, she didn't even request for next business day and they just automatically told her to pick up her passport with the visa next day.

There's no problem with that. In fact, this is what you should really do. Since your husband is on TN, you should apply for a TD visa and enter US on TD status instead of B2.
