ok fast a question regarding about my citizenship. i got my green card in hand on December/27th/2007 . so when should i apply for my citizenship Oh i am applying via the 3-year marriage route

As long as you meet residency requirements, you should be able to file around Sep 27-28, 2010.
 
Wait a second! You have to be married to a US citizen for 3 full years, i.e. the person has to have been a citizen for the whole 3 years before you can apply under the 3 year rule. Then, if you meet the 3 years married to a US citizen then you can apply up to 90 days (85 better) days before the 3 year anniversary of your Green Card. A lot of people lose money because don't know that they have to have been married full 3 years to the US citizen spouse. I hope this helps. Use a date calculator or spreadsheet to deduct 85 days from the date of your 3 year date. Be on the safe side, you don't want the application to be rejected by having applied too early.
 
Hi, yes i have been married since 2003. but what i dont understand is.. i thought i can apply 3 years mins 90 days, but now i got a different answer what do u mean by (85 better) ?? so it will be 3 years mins 85 instead of 90 days ???
 
Legally, you can apply 90 days before.

However, in many cases, the process is moving so fast that people are getting interviews in 70-80 days after filing. What then happens is that even if the interview went well, the IO just keeps the file on hold because the #days of residency is still not complete. Sometimes, the IO will approve the case right when the 3 or 5 years are complete, sometimes they will forget and people will keep waiting for an extra month for approval.

The other factor is that USCIS is usually not forgiving with respect to early submissions. So if you miscalculate by 1 day, or even if you calculate right, and USCIS mis-calculates - they deem the filing early and can just reject it.

So the 85 day advice is to protect against CIS miscalculation, and the 70-80 day advice is to protect against your case moving too fast to be approved at the time of interview.

Re file moving too fast - you can check the processing times of your DO by reading about other's experiences ... not all DOs have the same speed. Anyway, by the time, you are ready to file --- a lot could have changed in the next 8-10 months, so check the information then.

What counts is when your green card was approved (the "resident since" date on the green card), not when you got the card in your hand. The approval date is usually anywhere from a week to a few months before physically receiving the card.

The second point is that although you were married in 2003, that may not be enough because it is also necessary for your spouse to be a US citizen for the last 3 years.

You can apply up to 90 days before you have 3 years of continuous residence as a LPR married to a US citizen for 3 years. In your case, it means anytime after Sept 28 2010 (provided you don't break continuous residence).

Note: September 27 is 91 days before Dec 27, so make sure to apply after September 28 to be on the safe side.
