When future employer files...

Hi,

My labor is filed by my future employer who does NOT hold my H1 and have never worked for him.

When GC is sponsored by future employer, I'm told that we should ONLY file for consular processing and we can NOT file for 140/485? Is it true?

Can we not file for 140/485 and EAD at the same time, when my future employer sponsors my GC?

Is this future employer thing really works? If I were INS, I would never belive it.
 
Thank God you're not INS :-) just kidding.

Well, why not!? In my case I've told this employer that I could make money for him, if he sponsors my GC and he likes my qualifications. And the advantage for me is that this employer is located in a place where Labor processing is very fast. So its a win-win situation.

In future, If I will work for him or not is totally depending upon the unforseen circumstances, and is a different story.

What you have heard is incorrect. You can opt for either CP while filing I-140 OR file I-140 along with I-485 and EAD/AP simultaneously.

INS should be convinced that the job offer is legitimate. If you are already an employee with the sponsor, it makes things easier.
If your future employer is a reputable and well established business you should be OK.
