When does one Initiate AC21

Folks,

I would like to know as to when one would initiate an AC21 notice to the INS .

Is it after joining the new company ? or
Before Joining the new company ?

Also, What are the documents that I would need needing from the new company AND my old company ( if any ) to initiate the process ? .

Would appreciate some help and guidance .

---better file AFTER joining the new company becase USCIS may ask for new company paystubs
or
Before Joining the new company ?

1 your Intent change letter that you would like to work permanently with XYZ after I-485 appoval
2 New employer letter for same /similar Future permanent job offer lette ( search the thread "sample AC21 lette)
3 Copy ofyour I-485 filing reciept
AND my old company ( if any ) to initiate the process ? .
---- just try to ask for approved LC copy particularly form ETA750A becase it has your job duties in item13 on It and it will be easy to write the SAME job duties on new employer letter. copy of I-140 fing or I-140- approval and Copy of I-485 filing
Would appreciate some help and guidance .
 
Inform BCIS on your own or thru Lawyer??

Can we do this process on our own? sending the details of AC-21 to BCIS or we have to go through a Lawyer?

I am also in the same Situation as Tiger3260. Also Please tell me whether it is good to send this letter now or wait for the RFE and reply them then.

Lawyers are charging very much ( from this stage), any details of lawyers with Nominal Rates??

Please advise.

It works out to $3000 for me + wife to send this AC-21 Notice to BCIS + any RFE related to this AC-21 issue only. I guess $3000 is more ( what do You suggest/)
Additional filing fees + legal Fees add for EAD + AP Filing..
Any ideas, lawyers with lowest Fees and efficient services??

---that is upto you. USCIS does not say that you must use Lawyer

---- I will send it now becase they will have letter attached to your pending I-485 file, if you dont send then RFE will come to lawyer who filed your I-485 and with RFE they ask long list of documents

Rajeev Khanna (of this portal) gave me a better quote than that. Or even Sheela Murthy (or murthy.com) not to speak of a local lawyer. In short, shop around.

------3000 is too much, why your wife if she is dervative needs AC21??? only Primary file the AC21

----- what is this Additional filing fees ???? for EAD AP you have to pay, why cant you directly apply EAD and AP?? why you want to use lawyer for EAD and AP???

---- look for other good lawyer just to file AC21 ONLY, EAD AP you can file directly no need to pay any lawyer for EAD or AP.
you can also directly file AC21, see the sample letters posted in other thread

Thanks Guys,

I talked to my Lawyer today and he says that we don’t have to sent AC21 papers until there is a RFE from INS . Is this true ?

Also , he says in all most all the cases the certifying officer would ask for a new employment letter and that we would be sending in the AC21 only at that time . I am not sure of this ...

Is this true ?. Can someone shedddd light into this one please.

What would be the format of the letter that you would get from the HR . Is there a specific format that your Lawyer wanted to get the letter .


Do you see most cases getting a RFE in 485 , irrespective of whether you change hobs or not .. ?
