when does INS check the offered wage against LC wage?

Can somebody please tell me when and how the INS will review the offered wage verses the wage in LC? My lawyer told it's only when we file for I-140, and INS will look at W-2 form. And as long as the difference between W-2 and LC wage is within 12% range, the case will not be questioned. Is this true?

No need to send W2 with I140, they will give a RFE if it's needed. Maybe another one in 485 these days.
