Hi, just found out the DOS has approved my j waiver. do i have to start job with in 90 days of cis approval or 90 days of getting H1b or 90 days of completing fellowship (June 30, 2005) ?.

but..

thanx inmeddoc. I checked the conrad 30 sites of few states. Ohio clearly states that it is 90 days from h1b approval. Wisconsits site mentions 90 days after residency/waiver approval. W Virginia states its 90 days after BCIS approval . Can any veterans ( aka j1victim, kidsdoc) out there clarify ? Does the BCIS waiver approval notice state what the exact requirements are.
Thanx

I had the same dilemma in 1998, i obtained my J-1 waiver, but H-1B quota was over for that year and I had to wait till october (4 months) after obtaining the J-1 waiver to obtain my H-1B. My research at time led me to the conclusion that you are required to apply for a H-1 B visa within 90 days of obtaining the J-1 waiver.

I haven't heard of any problems. There have been many people who were in same boat. they started their waiver job AFTER finishing residency (well beyond the 90 day deadline). normally you are supposed to start waiver job within 90 days of waiver approval by CIS (not DOS)

If you search this forum "physicians" for last 1 year, you will find some posts there. Those people had waiver approved around 1/04 and residency was to finish in 6/04. you may try to contact them.
