When can you file I485 once visa is available?

I've got my I140 and have been waiting for the visa. Now that it passed my priority date in the Oct. bulletin, do I need to wait until Oct.1st to file it?

Your application should reach USCIS on the 1-st of October or later. You can send on Sep 30 with overnight delivery

My lawyer told me that it's not necessary to wait till the 1st of that Month to file. The moment CIS releases a bulletin that shows your PD as current, just file straight away. Anyway, by the time your 485 papers reaches the Service Center and gets processed, it will most likely have passed the 1st, so don't delay. FILE immediately! Don't you want the GC?

And if the 1st of the month hasn't passed, your case gets rejected immediately, and you need to file all over again.
