When can you apply for re-entry

Guys,

If one stayed out of the US for 1 year, when can H-1 be applied:

1. Only after the completion of 365 days? OR
2. Prior to the completion of 365 days but with an effective date after the completion of 365 days? For example apply around 330 days (like a month before) or something like that.

Will this be different if it were L-1?

L1, you mean one year out of USA on 6-7 year L1? Yes.

This is good to hear that it can be applied before 365 days.
The company is checking to see if they can file under blanket L-1.

So, that is why I asked if it would be different if the visa category was L-1. Yes, I'm presently out of the US doing my 1 yr. mandatory time.
