When can you apply for L-1

Guys,

If one stayed out of the US for 1 year, can L-1 be applied:

1. Only after the completion of 365 days? OR
2. Prior to the completion of 365 days but with an effective date after the completion of 365 days? For example apply around 330 days (like a month before) or something like that.

Here's the deal,

if one had spent the full term on Hx/Lx then one has to be outside US for a full 365 days before applying for re-entry under any visa even with post 365 days start date. This is important since USCIS (INS) and/or Consulate has to be sure that the applicant has met the requirement.
