When can i apply?

I'm an LPR since 03/30/2005.I will be applying based on being an LPR for 5 years.When can i send in my N400 application,without risking the eligibility date?

when i can apply?

I am citizen.
My father came to US on b1/b2 visa in July'05. He got GC in July'06.
In Jul'10 he will complete 5 yrs in US and his GC will be 4 yr old.
Since July'05 he is visiting out of US only once in a while for few weeks.

When should he apply for citizenship?

But in example you have taken here N-400 is sent in about 40 months only after GC Approval. Can you please clarify further.

Could it be that he/she got married to a USC, and GC is based on that.
Or even if GC was regular, he/she filed under marriage based Naturalization.

If fact I was looking for some info as when the counting for five years time starts?
Does it start from date of GC (Jul'06) or from the date of regular stay in US(Jul'05)?

A friend of mine is of the opinion that it should be five yrs from Jul'05,when he moved here. And he should have spent at least 3 yrs here after GC (jul'06) after deducting his visits time out of US. Can some body confirm?

That is not an example. Its my timeline. And yes, I applied based on marriage to a USC. I was eligible to apply 33 months after my GC was approved. I applied 40 months later mainly due to my procrastination :)

The counting starts whichever is later. So in this case, the counting starts Jul '06. You are eligible to apply 57 months later which is April '11.

There is a 3-year rule for those who are married to a US citizen, and the 5-year rule is for almost everybody else. Don't mix them up. And the years start counting from the first day when you became a permanent resident, not when you moved to the US.
