Hi All,
I have a confusion regarding when can I apply for citizenship.

I got my GC in 2002 Nov. I went to India after 13 months in Dec 2003 (applied re-entry permit citing personal reasons)
I came back in April 2005.

When can I apply for citizenship.

Thanks
Chapu

jan 2010...again depends on how u got ur gc...if u got it through marriage it is going to be apr of 08

got it through rigrous "EB-3" employment procedure..

I saw on other thread.. that you yourself had taken this reentry permit..

Did you talk to a lawyer about it or just avoided filing it early..
I see it is written this way on the 131 documentation.. but should'nt it be better to take advise from a lawyer.

The last 364 days of your stay in India count toward your continuous residence requirement. So you can apply 4 years and 1 day (2 years and 1 day if applying as the spouse of a US citizen) after your return provided you meet all the other requirements. Note that while using this option, you cannot avail yourself of the 90-day grace period that is available to the typical applicant.

You can apply after 4 years + 1 day from the date you returned to US in April 2005. So that will be around sometime in April/May 2009. This would be true if you don't take any trips abroad that lasts more than 6 mos on a single trip. There are physical residence requirements of staying for 30 months in the US also.
