When am I "safe" with CP?

Hi,

I just got my I-140 approved 1 week ago (Mar 28th/03).

Does the 180 days rule apply to CP? If so, when does the 180 days start to run?

I applied for I-140 on August 5th/02 (that's the Receipt Notice Date).

I'm not sure which category... can you explain? sorry I'm not very familiar with the process.

180 day rule

180 day rule does not apply to consular process.

The 180 day rule applies to you at this point, only if you have
applied for both I-140 and 485 concurrenlty. ( I don't know
whether the concurrent filing rule came into effect in Aug'02).

If your's was a concurrent filing, then the 180 day clock starts
ticking from the day it was filed.

If you have opted for the Consular Process in your I-140
petition, then the 180 rule does not apply to you.

So, how long does it usually take from this point until I have to do the interview??

I know there are a few steps in between, but can you give a rough estimation?

a) The Category:

Is it employment based (or) Family based?

b) What process did you opt for in the I-140:

Is it Adjustment of status (or) Consular Process

c) Which Consulate ?

OK.

Here are the steps again:

1) NVC sends file to National Visa Center - ( approx: 10 days)

2) Case is entered in NVC system- ( 3 or 4 days)

3) NVC sends the fee bill to your attorney ( 10 days or so)

4) The attorney sends back the payment to St.Louis.

5) St.Louis office collects the payment and informs the NVC
( 15 to 20 days )

6) NVC generates Packet 3 ( 1 week - 2 weeks)

7) Your attorney receives the packet 3.

8) Packet 3 is sent back to NVC.

9) NVC receives the Packet 3 and enters in the system ( 1 week)

10) Review of Packet 3 ( 10 days to 20 days )

11) Case file is sent to your Consulate.

12) Consulate receives the case, enters in the system and schedules an appointment ( ??? I do not know how much time
the Columbia post is taking )

My I-140 is approved as on 4/1/03. While filing I-140, I had intimated that I was interested in doing consular processing from Mumbai.

From now on how do I find out when I should expect PAcket3, when NVC will receive it, when NVC will forward to Mumbai consulate, when Mumbai consulate will forward Packet 4 and schedule a consular interview???? At what point do I get some kind of a reference/ case number for the interview coz I understand that the I-140 case number is no longer used for reference purposes?

Is there a web site where i can find these dates and next steps after I-140 approval?

Any information is well appreciated.
