I got married this February to a US Citizen and I am on H1B right now. If I apply for Green card through her right now, what forms would I'll have to file and what is the average processing time for the whole procedure?

Also, would I get my work permit with my green card or before it?

I know these are saome pretty basic questions but still wanted to get soem thoughts.

The processing time varies from 4 to 12 months.. approximately, depending on your case and on your local office. Some offices are faster than others.
Depending on when your H1B expires, you might not need and EAD card at all, since you are already allowed to work with your H1B visa, and the EAD is your work permit until the Green card is received. You could, however, apply for and EAD, just in case you will decide to work for a different employer other than the one that sponsored your current work visa..
Good luck! :)

Rosie,

Thanks for your reply. That is actually one of the reasons I want to get an EAD so I don't have a restriction of working only with the employers that sponsor H1B.

So would my EAD come with my green card or earlier?

And is it safe to travel during the time during these 4-12 months when your application is being processed?

Rosie,

If you don't use your EAD and you still work for your current H1B Employer, you can still continue to travel under your work visa for as long as it is valid. If you do use the EAD, then you can travel under Advance Parole. This document can also be requested when filing for AOS.

Are there any travel restrictions on Advance pay role?

Also, how would I find out what's the average processing time if I apply from Detroit?

If you request the Advance parole for multiple trips, then you can use it as many times as you want. Keep in mind though that if they send you letters that require action on your part and you are not in the Country on time to reply to them, they might deny your application. You can use the Advance Parole document for short trips so you don't compromise the AOS process.

You can check processing times for each DO here: https://egov.uscis.gov/cris/jsps/ptimes.jsp

keep in mind that these are just estimates.. every case is different.

Thanks Rosie,

My lawyer says that I can travel on Advanced Role for any length of time less than one year and it would be ok. Does that sound right?

Also, what if I leave my job during my green card processing and my wife has no income? Does that affect me?
