I just want to discuss with you what's going on.
There is people with ND 2001 (adjustment scheduled for FY 2006-2007) who has been receiving FP notices, the assumption was that BCIS was working onthe 22000 cases of the lawsuit. Now, knowing tha they had appealed, what's going on? Why people with 2001 ND is getting FP notice?
Is it possible that even with the appeal in court, they start working the lawsuit cases? It doesn't make sense to send FP notices (valid for 15 months) to people that is going to be adjusted in three years.

I have three friends who got FP notices. They have I-485 Receipt dates in January, February and June, 2001. My receipt date for I-485 is July, 2001. Now i am guessing they are sending FP's until mid of 2001(that's June, 2001). Because all the persons got the FP's on the same day. Is there anybody received fingerprints who applied in July, 2001. Your reply will be highly appreciated.

Just a wild guess, they might be having a software bug that causes them to issue premature fingerprint notices.

Just got my FP notice today:
My I-485 was recieved on July 25, 2001.
This is the first communication i've got from INS since submitting. The form also has a FP appointment for the begining of June.

What's happening, do you think it's a glitch in the system, just the usual irrational behavior from the INS or something is about to happend soon and we will be all get our green cards.

I think they are trying to account for everyone in the country and make sure that none of pending asylees are terrorists. Remember, many asylees from the Middle East were members of terrorist organizations that carried out attacks in their countriies and were granted asylum due to their political persecution. Or, they are trying to give a false impression that things are moving even though they are not. Either way, one should not get excited about these FPs because we all know that they mean nothing.

From the NSC report posted on immigration.com:

"Inquiries regarding asylee adjustments that are ready for adjudication

In cases were an applicant aged 14 to 79 whose case filing date is on or before November 16, 1999, and who has not received an ASC notice for fingerprinting within the last 15 month period, should notify our office through existing liaison channels. With 5.5 months left in fiscal year 2004, there are pending cases awaiting fingerprint results and necessary background checks before they are adjudication ready. Once cases are found to be adjudication ready, they are worked in approximate date order. Thus, applicants with cases filed in October or November of 1999, will likely not hear from the NSC until later in the FY when the older cases have been adjudicated.

Filing dates of cases the NSC is currently adjudicating.

Cases filed on or before November 16, 1999 are currently under adjudication for FY 04. The most recent revision of the asylum adjustment "forecast" appears on the NSC web site. In preparation for FY 05, the NSC has begun sending fingerprint scheduling notices to applicants with cases filed on or before May 12, 2000. This process will continue through the coming months consistent with ASC slot availability.Filing dates of cases the NSC is currently adjudicating.
