I appreciate everyone reply o my previous post !! one more think please


FIRST :

today i contact immigration lawyer and he said that i cant file I-751 right after the divorce finalized i have to wait 90 days before my GC expire date .( then i can file on my own ) so if the divorce finalized in 4 months from now im i able to file ???? or i have to wait the 90 days before the expire date ???????? ohh soooooooo confused i dont know who is right !!!!!!!!!!!!!!!


second :
i know now i have to contact lawyer divorce... but anybody know how long will take ? because my GC expire end jan 09 . hope the divorce wont take year ?!!!!!!!!!!

first: get a new lawyer. instructions for the i-751 state clearly that in the event of a separation (by divorce, annulment or death) you can file i-751 on your own at any time before the expiration of the GC.

second: your GC expires in one month?!! why didn't you file i-751 60 days ago?! :eek:

I am also going to something similar like yours and have been studying and have recieved several comments on this forum. You can file after the divorce is finalized and have the decree in hand.

Talk to a family law attorney and see how long it takes to settle a divorce in your state. different states have different laws and takes time accordingly, so make sure you know how long the divorce case will take with respect to the state you will be filing it in.
