What will happen if we change job after filling for NIW(I140) also guide me how much time usually it takes for Nebraska center to open the case and make decision and does it matter if we have solid letters from Federal agencies support for national interest waiver.

I cannot comment on Nebraska center. My center was CSC. There are really no guarantees on the processing times but the most representative times are the 'current processing times' posted on the USCIS website.

It does help to have letters from Federal agencies. Sometimes USCIS even recommends submitting these at the RFE stage.

If you change your job, its safer to move to a similar position (i.e one which would help you obtain consistent letters etc.) in case of an RFE. In some RFE's USCIS even requests evidence that the applicant's CURRENT position is in the intrinsic national interest.

See the only reason why I asked this question was that I read somewhere if you get GC from NIW you cannot change your job area ...now my NIW is filled on a specific program which I wrote using MS technology so will I be able to work in any other firm using or writing code or even start my own business down the line say about 8 years.

I'm not sure USCIS expects you be an indentured worker. However, if you've obtained non-physician NIW GC, its best to remain in that field (or at least be able to justify moving to another similar area) for perhaps 6 months after you receive your GC.

If you're going to lose your job and must look elsewhere, try and find something similar if not identical until you receive your GC. Physician NIW has some kind of 3 year work stipulation which the non-physician-NIW does not. Basically, all I'm saying is that if you make a move while your GC is being processed be ready to answer how your new job duties also fit in with the scheme of things promised in your NIW application.

This is all I can answer. If still not clear, perhaps some other forum members could help clarify your doubts? Also, keep in mind that most of us here are not attorneys. Not all USCIS rules are in black and white. So obtaining good counsel is perhaps a much 'safer' bet.

If you change your job after filing for NIW I140, nothing will happen, I did that. Also, it does not matter if your new job relocates you to a place that no longer falls under the original service center's jurisdiction. I used to fall under NSC jurisdication and then moved to a very different state which falls under different jurisdictition. My case was approved.

It helps if you have strong letters from Federal Agencies if the person writing the letter is competent to make a judgement on your work. For example, if you are a biomedical scientist and the person who writes the letter is a business major, the letter will carry no weight even if he works for a federal agency. In any case, you dont really need letters from them. I had none from anyone in federal agency. All my letters came from the private sector.
