Hello there,

I'm in my eight year on H1 and my H1 is valid till last week of October 2007. I have filed our 485, EAD and AP during August and it's been received during second week of September 2007.

Should I file for H1 to maintain my status or pending EAD is sufficient after October?

Could you please help me in understanding my options?

First thing...

EAD doesn't give you status for authorized stay, it gives you valid permit to work for any employer in US if you meet AC21 reqs.

I-485 Receipt is enough to stay here without any other valid Visa, but you need permit from USCIS to work for someone....

Better to maintain H1b status until you are safe to move different company or to work on EAD....

If you do not get approved EAD(or H1 renewal is not filed yet) before last week of October 2007, you can not work for your current employer, and your employer must take off you of his payroll.

However your staying in US is legal based on pending I-485

Best option is to file H1 extension so that Extension must reach USCIS BEFORE I-94 gets expired
