Hi Friends,
Could you please help me follwing question. Thanks In advance.

Question:

I was in the USA since Feb 2003 on a L1 Visa. My company wants me to go
back to India in June 2006. But since I want to stay back in the USA, I
want to apply for a H1-B visa when the quota for FY2006-07opens in April
2006. I have an offer with a company and they are willing to apply my H1-B
visa when the quota opens in April 2006.

When the company applies my visa and they do the premium processing and if
my application is approved, can I work for that company from the day the
application is approved ?

If the H1-B petition is effective since October 2006, can I stay in the USA
and work from June on that petition after my L1-Employer asks me to go to
India ?

Please...please help me on ths one.

No, you can only start working from October 1, 2006.

No, you have to wait until October 1, 2006. You have to either leave the country in June and come back on October 1, 2006 or present in the country on some other status (such as F1, cannot work during this period) temporarily until October 1, 2006 and start working from October 1, 2006

Ask this new company to apply for your labor in PERM right now, which can be approved soon, and apply for 140 and 485 in october 2005. Hopefullty you will get EAD by June 2006, and join this new company.
