Finally grabbed my Rfe... Lawyer still sick..Need EVL, Pay Stubs W2's... I have a problem here..My salary right now is less than described in LC.Still continuing with the same employer last dt for submission is some where during feb 3rd week..can i go with it or what am i suppose to do???
pls let me know!!

It is okay to make less than LC prior to getting GC. The LC salary is only valid upon approval. Is it possible for you to get a letter from your company stating that they will pay you the requiste salary post approval?

Have you changed your job after applying for GC under AC21?

I havent changed my employer still working with the same employer..You mean to say what matters most is EVL (right).
I will be able to get it..i hope for best..

I happened to be browsing by. Have a suggestion could you make your last salary check , ie Jan 04salary= LC by encashing your leave, or taking an advance or something like that. Submit that along with an EVL which states LC salary will be paid after GC and you should be fine.

One of my friend got GC approval 3 months ago. He was without job almost 18 months and his W2 shows only just 10K for the last 2 years. He got RFE. He sent 3 months paystuff, W2 copy, EVL and CERTIFICATE FROM DOCTOR . He had some problem in his hand and he just visited doctor to get some advice some time last year. he used that chance and got some letter.
All these documents he sent to lawyer. Then, went to india thinking that USCIS will reject. But fortunately he got approved.
He came back again using AP and got stamping, now he is working in one good company.

So do not worry, talk to your lawyer. My friend did not know how his lawyer handled this. All the best.

The key here is definitely an EVL stating that you will be paid the requisite salary upon approval.

Also, it is not a bad idea to actually look around for a job that pays you the requiste salary or more. I am surprised that you are working for the same company that filed your LC and 485, and the company is not paying you what they stated they would in LC.

Finally culd get one paystub equivelent to my LC..i wuld like to know if two paystubs show salary less than LC an one paystub showing the amount equivlent to LC salary will that work out..

yeah 140 still with same employer.. sticking up with one employer from 6yrs for GC. GC Filed in Jan 2000..having been getting quieries for 140- EAD and also 2nd fp finally RFE..

Paystub is not as essential as EVL! As long as you have EVL, you don't have to worry about making LC salary. The LC salary is only due upon approval of AOS! GC is for prospective employment and NOT current employment.

Since i was little worried initially..i encashed all my leaves and got one paystub = LC salary so in my 3 pay stubs one pay stub shows LC salary and the other two less than LC...Do you think it is okay to do? or will create any problem and also I got my EVL..
Finally getting ready to take off...
