I passed 19 months from 485 RD. No approval,No FP2 and No RFE. I asked my attorney to enquire but with BCIS..No use. I'm so frustated now. I got new offer from another employer. I'm finishing my assignment with a client with current employer. If I take up new employer...do I need to inform BCIS. Suggest me friends.

1) you shouldn't get FP2 yet. your FP is not expired
2) lawyers are emotionless, they won;t help you
3) don't tell INS. because you can get approved any time.
if you tell them, they will send you RFE

Better prepare to inform

I think its better to inform the INS if you changed job regardless of how close you are! In case, they did generate a RFE and you provide info from the new company, it might create some new questions (may be not). Who knows what INS will do?

Better follow the procedure! There is nothing wrong with it (especially if you are moving to the same designation and same or higher salary).

My opinion 'is all!

well, his case is probably at hand of an officer now. Even if your inform them, won't be get there in time. You could argue with them because you just change job, and your case is assigned with an officer, you don't need inform them. plus you need at least 2 months salary check to proved your new job, and if you don't, you can't proved you're working for new employer.

I'll say hold. Plus many lawyers suggest don't send. Of course, if you're March RD, and you change job, you could do that. But since he is Dec RD, and he hans't started new job yet. I would say no.

another thing, keep track of your 140 status, sometimes, if you change a job, old company revoke your 140. I would suggest you delay changing to new employer for couple of months, that's the safest way

Probably. I could do that. I'll prolong this new offer till Aug 15th and I hope I'll be approved by that time. Then I guess I won't have any problems. This BCIS is delelaying the process like any thing and creating so many new problems.

I just heard from my lawyer that many BCIS staff are in training and resuming regular duties from monday. So we may see approvals .....

wow. magesh didn't lie. That's what I thought too. Slowed own way too much in July. Hopefully. we can get back to normal speed, that is 50% of a month RD in one month spread.

Thanks!

Wow... that is good news. And, I heard about it from some other source too (about training...not about returning part). Hopefully we will see lots of approvals next week onwards.

There were few 485 approvals, I haven't seen a single 140 approval from VSC in last two weeks.

Hope to see your approval soon.
Good Luck - Sanga.

Go ahead and join

If there is a danger of being without a job. Jump right now. It is always better to have a job and then face the situation. As long as you have a job you will be safe. Nothing lese matters.

Informing INS or not is a dicey situation. Like someine mentioned here even you tell them they might not get it in time to raise a rfe. So you will be safe that way. So you are okay even if you tell them.

When I changed jobs in 485 I did not have trouble tellign them. I got an rfe though but not job related. RFE was for my medical. So lettign them kow that you changed job will not necc.ly get you a RFE.

You don't have to inform them

Sorrry to hear that 19 months passed. Same here. You can send Enquiry form to the BCIS vermont office to find about your case. This may help you. I send one already. Let see how this one works out.

At present situation, don't worry to change jobs to have constant income. If you get RFE then that time you can send Change of job form.

Wish you best of luck
