My mother petitioned for me while she was a permanent resident. After seven years she became a USC. My priority date is already current but I assume my status has changed on her becoming a USC. What is my next step? How do I inform the authorities that I am current and my mother is a US citizen?

write a letter to nvc asking them to upgrade your petition put a copy of your moms citizenship and your i130 and send it to nvc u can find the address at nvc website not uscis once u recieve a response from them, it takes about a month to get a response from them, then fill out all these forms i485, i765, i485a if neccessary, i864, i131, and the biographic form and send 'em all to chicago lock box with appropriate fees, goodluck.

I have been waiting since 1998 for my case to become current and during that time I got married and had some kids. How will this affect me now that my priority date has become current? .

Did you get married before your parent recieved citizenship? If so you will have to get a new petition file for you.You said you was sponsered in 1998 even if you send in the citizen certificate you are not current they are presently working on F1 sponsership 1997.Check the bulletin.

Maybe I am reading it wrong but I am checking the bulletin for the texas processing center and they have reached 05/07/2001 sindy.

But I looked at the processing dates for Texas where my file is and it is current. Actually they have reached 1999 and I am 1998.

then follow the instructions. call immigration and let them know about this. they will then look into it and send you a letter in about 30 days. you wil lbe approved soon after that or if there is a problem, who knows. but in my case it went to the CA center (a method of speeding up things) and soon it got approval.

Hi determine,Why did'nt you wait until your mom recieved her citizen certificate then marry? Now you are no longer covered under unmarried children petition.Your mom have to filed another petition for you as married son so your category will be F3.You cannot retained your first petition date as you got married before she became a citizen.I hope you understand and ask her to file as soon as possible because the waiting time for F3 is 8yrs and over for India.

You said you was checking the dates at Texas processing center. You was checking at the wrong site you was suppose to check at National visa center Visa Bulletin Site but it no longer matters for you original petition is now invalid as you had gotten married.Sorry if I sound harsh but it is the truth check with an honest immigration lawyer and they will tell you the same thing.

No I understand Sindra and you are right about my status not being valid. It's a bit unfair though. I can't wait another eight years though so I think I will let this one go. Thanks for everybody's help guys.

It is good to know you understand what I telling you but I still think you should let your mom file for you because of your kids. There is fellow in my Village that went through the same thing like you he had to married legally for he is a Pastor(a lot of people who got sponser marry only with the ceremony then wait for the sponser to uplift their citizen to do it by the law)He have four kids and his priority date is 2002 for F3 so go ahead and let your mom refile and don't think about it NVC will surprise you one of these days and your kids will be gratefull for the opportunity to live in the USA.
