What to do if online case status details Conflicts with NOA?

When I type in the ESC number shown on my NOA into the case status webpage it tells me that the application was received on Aug 1st 2007 - This is simply wrong. The receipt (and priority) date of July 25th as stated on my NOA is correct.

The NOA date is correct, but I'm worried that some data entry person has entered the case into the system incorrectly leading to a wrong reciept and probably priority date.

Anyone else have the same experience of online status not agreeing with their NOA details?

Thanks,

S.

... And someone at a later stage may look at the computer record and (incorrectly) conclude that you paid an insufficient fee as well... However, I think that USCIS may also have a copy of the NOA they sent you (possibly even an exact image stored on the computer), so I think this may be an easily correctible data-entry mistake... I would suggest writing to them.

The date on the online case status typically is the date they punched the information into the system. Once your case has been accepted, don't pay too much attention to that date. They will make decisions based on the date on the paper notice.

Ok, Thanks for your replies obajaj, jackolantern. I'll trust that all is well, and let things be.

Cheers,

S.

We had the same case with out applications last year, the date on the web message was off from what out notice said by some 4-5 days I think.

Online checking of status is usually wrong or not current. It is very often not updated at all. You are lucky you even got into the system. There are many including myself that were never entered into the online system at all, so we had no clue where we were in the process...

Case Status Online Data Is Questionable

I originally sent joint I-751 to remove conditions on 10/2003. Marriage fell apart and got divorced. Two months after divorce received approval and 10 yr GC. after 5 yrs, applied for citizenship and placed in removal (deportation) proceedings because I did not file a waiver I-751 right after divorce and before joint approval. I have now filed the waiver as instructed by IJ.

Now when I enter the new receipt number dated 9/10/2007 the case status online states 'Approval notice sent. we sent an approval notice on 11/5/2004" Are they trying to adjust my status from 2004, when I got divorced as the NTA states that date as termination. But this date does not match divorce date.

The receipt number written on check does not match the NOA. I have received two NOA, one extending my conditional status for one year and other for fingerprinting.

What do you make out. Was I approved for waiver with out interview. I sent in 3 inch thick file of evidence with EVERY conceivable evidence including copies of all my I-485, I-130, taxes you think and I sent it.

Well, well, well. I mailed my SECOND I-751 with good faith waiver to VSC by FEDEX next day on 6/29/07. They signed for it on 7/2/2007. My lawyers check have dates with receipt numbers EAC........... Dated 7/17/2007. Called NSC three times till 9/8/2007. No status on Reecipt numbers. No status online. BOOM, receive receipt notice dated 9/5/2007 on 9/10/07. Status extended one year blah blah. Biometric notice date 9/10/2007. Biometrics done 9/20/07. Checked status online. weired. approval notice sent on 11/5/2004?????? what???? Infopass, nothing new. just I-551 stamp. Already had 10 yr card in pocket from 2004. Did not take. Appeared for Removal proceedings hearing on 10/31/2007. We denied all charges in NTA. USCIS trial lawyer said she is not ready as she only got the file recently.Judge gave her 1 week. Today was the second hearing. See waht USCIS lawyer states to Judge. "Your honour, the service is moving for termination of proceedings, without prejudice". Boom: Case is Over. No second I-751 interview. No Approval notice received. I just keep my old buddy ten year card. Nothing new card or any thing.

What does this mean. The judge states,Mr. M, you do not have to come back here any more. Just keep in touch with your lawyer for any updates.

What does without prejudice mean. Please post the response. I am applying for naturalization this week, may be.

"Without prejudice" means what happened in the case (including the mere existence of the case) will not be held against you in the future.

For example, if your citizenship application is denied because you failed to meet the 5 year continuous residence requirement, it will be denied without prejudice; you are eligible to reapply when you have met the 5 years, and they won't hold the prior denial against you. But if it was denied because you committed a crime, it might be denied "with prejudice".

Dismissal without prejudice

The legal definition of without prejudice is different from the layman definition, rather it is entirely contrary: here is the difinition from legallingo.com:

dismissal

n. 1) the act of voluntarily terminating a criminal prosecution or a lawsuit or one of its causes of action by one of the parties. 2) a judge's ruling that a lawsuit or criminal charge is terminated. 3) an appeals court's act of dismissing an appeal, letting the lower court decision stand. 4) the act of a plaintiff dismissing a lawsuit upon settling the case. Such a dismissal may be dismissal with prejudice, meaning it can never be filed again, or dismissal without prejudice, leaving open the possibility of bringing the suit again if the defendant does not follow through on the terms of the settlement.
