hi all

i won the dv2010 lottery from australia. at that time i only just started seeing my current gf so we didnt apply and didnt qualify as a spouse. i have since moved and been here 7 months and she has visited under the vpw twice for 2 x 12 week stints. what are my options to try and get her a more permanent move to the usa? we have applied for the DV lottery for her last month but that still a long shot. she is not highly qualified...she has pretty much worked in hositality her whole life as not sure if she would qualify for any work visas? we want to be together but just cant see how she will be allowed to stay even if we get married as isnt it a 4-5 yr wait outside the country b4 they will allow her a spouses visa?

Marry her and file an I-130 with consular processing. The backlog for spouses of green card holders had dropped to less than 6 months (although the end-to-end process may still take a few more months than that due to the various formalities and paperwork).

marry her in the usa then file the paper work back in aust or could it all be done from the usa? wow thats a massive drop from last year when ppl were saying 4-5 yrs wait

You can marry her in the US, but she'll need to complete the final steps (interview, fingerprinting, medical) outside the US. She can't stay in the US to complete the process after entering with the visa waiver, but you can file the initial paperwork (I-130 and supporting documents) while she is in the US.

Yes, it used to be a 4-5 year backlog in the family 2A category. According to USCIS, most of the backlog got cleared up because many people were abandoning their applications altogether, or they switched to a different category (usually to Immediate Relative as a result of their spouse or parent obtaining citizenship).

sweet. think that may be the way to go then. i was thinkin the gfc mite have scared a lot of ppl off coming to the usa. also can u explain the k3 qwikly? will that enable her to wait the process out in the usa or still have to do it from australia. no biggy i guess if it is only 6 months but just doing as much ground work now as possible
