What? No more USCIS updates???

Has anyone noticed that the 'USCIS SERVICE CENTER PROCESSING TIMES' web page wasn't updated on Friday? Normally it's update every 2 weeks, and the last update was June 4... so it should have been updated on Friday, June 18..... but it wasn't.

Darn! I check that web site religiously every 2 weeks so I can see that they haven't gotten off their fat asses and gotten any closer to processing my application (one damn month away).

Now, it seems they have taken this small pleasure away as well. :(

I too interested in seeing that update regularly. It's sad. But I have worsen.

I heard that there was a memo circulated in service centers last month. Based on that all the concurrent filed applications will be processed concurrently. i.e I140/485 will be cleared together and AC21 is not applicable to these cases. Anyway your I-140 will not be cleared till I-485 is adjusdicated.

If this is true then it's a big blow for those who filed concurrently and waiting for I140 clearence to change job. (like me).

Now I have decided to join some yoka classes to control my anger... :mad:
 
Do you know where I can find this memo? I've seen a few people mention it and until I actually SEE the memo, then it all sounds like rumours to me. My immigration attorney knows nothing about it.

There has been a significant change in the way that the USCIS Service Centers will process concurrently filed I-140/I-485 cases. In a March 31, 2004 memorandum (Ohata Memo), Fujie Ohata, Director of Service Center Operations, issued instructions to the Service Center Directors regarding certain procedural changes. Under the new procedures, a concurrently filed I-140/I-485 should be adjudicated together. Previously, the I-140 was reviewed on an initial, cursory level simply to identify any clearly frivolous cases. The I-140 was then adjudicated independently, without regard for the processing of the I-485. The cursory, or prima facie, review was performed to avoid improper receipt of the benefits of the I-485 filing, including obtaining an Employment Authorization Document (EAD) or Advance Parole (AP). Under this Memo, concurrently filed I-140/I-485 cases will be processed and adjudicated simultaneously.

I-140 Will Not Be Processed until I-485 is Ready to Be Processed

The Ohata Memo states that, even when the I-140 is ready for processing and placed on the 'ready to adjudicate' shelf, it will not be processed unless the I-485 is also ready for adjudication. The I-485 is not ready until the fingerprints and name checks have cleared. Essentially, the I-140 will be held in abeyance until these procedures have been completed in connection with the I-485. This raises significant concerns for the application of AC21 portability. AC21 portability, as interpreted under current USCIS memoranda, requires an approved I-140 and an I-485 that has been pending for 180 days. Thus, delaying the I-140 adjudication until the I-485 can be approved inevitably will curtail the ability to use AC21 portability in most cases under these current USCIS interpretations. Of course, since AC21 is only available for long-delayed cases, if the new process speeds adjudications to within a six-month period, AC21 portability is not an available option. While we would certainly favor case adjudications within fewer than 180 days, current processing times are approximately two to five times this timeframe. Thus, this may not be a realistic goal, at least in the near future.

Very intresting note by INS to congress states that it is planning to reduce I140 time to 8 months in FY2004 and I485 to 20 Months

So clearly it shows INS has no idea of implementing Fuji memo, as I485 and I140 has diffrent processing time, If it is conncurrent processing either it should be 20 Months for I140 or it should be 8 Months for I485, ( Not in my dreams also :rolleyes: )

This has been a News for a long time and I don't think, beside NSC, anyone else is implementing it. And, see the way VSC is approving 140s. I have a friends who recently got 140 approved, but 485 continues to be pending.

Again, no update on the processing dates. I know the dates wouldn't be changed in the new release (and the upcoming releases too :-) ), but still would like to see the report for every two weeks.

If they process the application at this rate then we will be getting our application at the same date and year when we had filed (Assume there is an integer overflow in the year filed).
Sucks !!!.
