Freeze is over, Background check is in place , TPS is over, Special resgistration is over, So are we going to see a flood of approvals next week? Or is there an avalanche in Siberia or JLO's
backside which needs priority attention? I'm sure Sillyman will be upset if that happens ! Cheer up guys next week is going to be good thats my prediction and Im rarely wrong!!
 
Many Welcomes to one more out of the closet lurker! :) It is good to see so many new faces. The rest of us know each other a little too well now (just shows how long we have been waiting together).

I agree, things are going to turn around. It will probably take a couple more weeks to show up on the trackers though.

This is to inform all of you people INS is asking to come up with the name why the delay could be.

Here are the ideas I found in this forum.
1. F1 Processing
2. H1 Backlogs
3. AP Backlogs
4. EAD Backlogs
5. DHS Implementation
6. Changing INS to BCIS
7. Special Registration
8. Concentration on Finger Printing Expiry


Because of anyone of above reasons 485 process will be resumed in next two weeks.

If you have any ideas please suggest and INS will use them. If not, after every two weeks pick one reason and update your minds with next reason right now they are working on blah blah blah.....485 processing will be resumed in two weeks.

The good thing is you dont have to start at 1st reason. You can start anywhere because it's an infinite loop with no EXIT.

Be prepared to renew your EAD as long as you are going to live in US.

If your 485 is approved after your death INS/BCIS will send your approval (not your spouse's approval) to your wife.

thanks to all the folks here to keep all the 485 waiters moral up and give a hope for the bright days ahead.

Employment Authorization Document Automatically Extended to December 5, 2003

WASHINGTON - As part of the Administration's ongoing efforts to assist countries affected by Hurricane Mitch, the Bureau of Citizenship and Immigration Service announced today that Temporary Protected Status (TPS) for Honduras and Nicaragua will be extended for 18 months. The extension is effective July 5 and will remain in effect until January 5, 2005. The 60-day TPS re-registration period begins May 5.

￾gThis additional 18-month extension reflects the Administration￾fs continued commitment o provide assistance to the countries devastated by Hurricane Mitch,￾h said Eduardo Aguirre, Acting Director, Bureau of Citizenship and Immigration Services (BCIS) in the Department of Homeland Security.

In an effort both to provide ample time for eligible Hondurans and Nicaraguans to re-register and to prevent potential gaps in employment authorization while they wait for their applications to be processed, BCIS is granting an automatic extension of the expiration date of the Employment Authorization Document (EAD) to December 5, 2003. The automatic EAD extension does not relieve beneficiaries of the responsibility to re-register for TPS benefits.

This extension of TPS covers an estimated 87,000 Hondurans and 6,000 Nicaraguans. For more information, please visit the BCIS web site (http://www.bcis.gov) or call the BCIS National Customer Service Center at 1-800-375-5283.
 
Ridiculous!Insane!Garbage !!I wish these BCIS guys are made to wait like us sometime in their lives for something that affects their lives. Heartless, thougthless and lazy bunch of people
 
These excuses actually don't bother me too much.
If BciS has lower priority for EB AOS it must be consistent for every EB case.

But the fact, that they are processing March/April 2002 cases more actively than Oct/Nov 2001 MAKES ME SICK!!!

I wish I could look into eyes of the person who is deciding which case goes next! What's up? What happened to our cases? Are they wiped out?

93,000 re-registrations will be filed from 5/5/2003 thru 7/4/2003.
There are 50 business days, so 1,860 applications per day will be filed.
Where to be filed ?
If they were Service Centers, one SC must handle 465 applications per day, maybe plus EAD.
It's not a small number.
If CSC can handle 465 TPS extension per day,
it's easy to adjudicate only 100 I485 per day, isn't it ?

If you are from El Salvador, Honduras or Nicaragua, submit your application to the Service Center that serves the area where you live.
 
TPS and EAD in Nov 2001 thru Jan 2002

I checked scanned log file briefly,
and found that thousands of I821 applications being filed in three months
and that the number of I765 were higher than other months.
We may see the same trend in next two months.
I'm not sure whether it will affect I485 processing at CSC or not.

I scanned WAC-03-165 (5/7/2003) but found only one I821 case.
It seems not to affect other cases so far.

* Currently, the qualified religious workers other than Minister occupation are allowed to file a special immigrant petition (I-360) and once the petition is approved, they file I-485 to get a green card. Except the occupation of Minister, though, the law on the special immigration for these religious workers lasts only for three years and unless the Congress extends or reenact the law, the law is expected to sunset at the end of September 30, 2003. Under the current law, the people who started this green card process should obtain "approval of I-485" before the law sunsets. Since September 30 is only approximately four months away, the people who have filed either I-360 or the subsequent I-485 are nervous about the situation.
* For some reasons, the Congress has been passing law to extend this law for three years at the last minute during last several years, driving the religious organizations and their religious workers into a breath-taking situation. It is expected that soon, the Christian religious organizations, particularly Catholics, will pump up their lobbying efforts, pressuring the Congress to introduce and pass the extension bill.
* However, there is no guarantee that the Congress will indeed pass such law again, or even if they do, whether they will pass a law giving the special immigrant benefits to all the religious workers on identical conditions and terms as they did it in the past. People should thus live with the current situation of sunset of the law at the end of September. It has been the immigration agency practice for the past several years that as the date of sunset of this law approaches, they expedited the pending I-360 or Special Immigrant I-485 cases so that these cases be adjudicated before the end of September. Thus far, though, there is no official announcement by the BCIS instructing the Service Centers to handle these pipeline cases on "expedite basis."
* Thank God, we have some good news for these waiters. All the four Service Centers have indicated that they were aware of this sunset problem, and intend to adjudicate the pending cases as much as possible before the end of September! Additionally, the AILA is working with the BCIS to induce the agency to announce "expedite policy" for these cases. It appears that the reaction of the BCIS is somewhat positive and the BCIS may soon release such announcement.
* The people in the pipeline should also not neglect their own duties to assist the agency, assuming that the agency will adopt such expedite policy. Four months is a very short period of time. Unless the people collect all the evidence ahead of time against the upcoming potential RFE (Request for Evidence), even if the Service Centers wants to assist them, they may not have enough time to complete their cases before the midnight of September 30, 2003. Law does not, and should not, help those who sleep on their obligations and duties!! Remember that once the agency starts expediting of these cases, some of your colleagues in I-485 quieu will suffer, even though negligible, as additional resources within the agency should be shifted to adjudication of these cases. You should be thankful to your colleagues!
 
Religious workers prayers worked better than ours!!!

Nothing other than stuff we are already doing, writing to news papers and signing the petition!

AILA lawyers do know ground reality about our wait, we shouldn't have to do anything to make them kick INS in the butt!
 
So another excuse ( Religious visas expiring)! Why can't they just religiously do their job. Sick of hearing all this Garbage!
