What my lawyer said about adjustment:

I asked to my lawyer about adjustment. And he is the best. Here is my question:

Now that the cap has been removed USCIS has been moving
pretty quick. Right now they are processing I-485s with Received Date
(RD) of April, 2001, but some with RD 2000 has not been processed yet. According to the processing dates of Adjustment of Status for Asylees my I-485 will be approved in 2014. My RD is 08-2004. Any idea when I will be adjusted after the cap has been removed? Thanks a lot for your attention.

Answer of the best lawyer ever:

Hi, XXXX

We just don't know at this point. As you know, CIS is a
government bureaucracy that just goes round and round. Continue to monitor the dates. CIS has not yet addressed how it intends to clear its asylee adjustment backlog. It will happen...eventually. And thanks to the new law, it should be sooner than later.

What about USCIS strategic plan to reduce wait period for all types of applications to 6 months by the end of 2006? That means asylum based I-485 as well, right? Or they have some exceptions?

my lawyer told me at least 2 times, that they will reduce the backlog to 6 months for ALL the cases. INCLUDING asylees. There is no reason to exclude the asylees and they will NOT.

570 days to 600 days processing

I have a similar situation that you do. My ND is also about August of 2004.
I first received a letter from USCIS not even telling me how long the processing of the asylum case would take.

Then in December of 2004, the status of the case changed, and I noticed on line that it says it would take 570-600 days to process this kind of case. I asked my attorney if that's the case. He said that he would not be able to answer this question. But he told me that USCIS would process it in 600 days if I filed a lawsuit....

I think CIS make a mistake when they said that will process in 600 days. It should be 600 months. :D

Nice One!!

CI_Asylee,

that's a nice joked you cracked. Perhaps, there is a bit of a joke there, the rest may be true. Nonetheless, I now have a basis to file a lawsuit if nessesity arises. What do you say?

Aha! 600 WORK months. Weekends and federal holidays excluded.

listen up my fellow Asylees

Whatever USCIS says DOES NOT i repeat DOES NOT apply to Asylee cases. The ONLY solution to your problem is wait wait and oh yeah wait more. Every single person on this board has done it and now its your turn my friend. Get in line and enjoy the ride. Sorry but thats the reality :>

Yeah, we can formulate a lawsuit. They clearly stipulate in the Receipt(ND) that it will take 600 days. Oh my god!!! 360 days have passed since my ND plus the year backdated = 725 dias  . I demand my GC now.
