What kind of people are employed in the INS? As per Sheila Murthy the interpretation of the ACTA law for I 485 is that - only those who file after Oct 17,2000 are eligible for job change. The bureaucrcacy corrupts even the good intention of the legislature? Are they in league with the companies to hold us hostage?

I dont think this is the correct interpretation of AC-21... I confirmed with INS and this applies to anybody who has completed 180 days after filing I-485. Donot worry we are in the same boat..
Just wait for INS to give guideline in March 2001

I agree in part with Hanuman. The bottom line is that INS realizes this issue as an hot item and cleverly excluded this from their first memo. Interpretations apart, Sheila Murthy website merely says, INS is debating with AILA about job portability for I485 files prior to Oct 17 and that the regulations are due out by March 2001. However, I request Hanuman to post the details on the board about INS confirmation on this issue. I shall thank him for doing the doing the same in advance.

Here is another piece of info : INS is not accountable to any legal entity on how it decides cases. For instance, if they decide to process - odd number dates for 1 year and even for the next. they are perfectly entitled to do it.

I think you are putting yourself under great tension, pressure and uncertainity. Don\'t worry. INS is trying to do thier job. What can they do when they do not have enough people to organize everything, plan ahead, look at applications, send notices, type letters etc., And they get all kind of weird cases, twisted scenarios which need time to understand and process. When they have millions of applications to process, mistakes happen here and there. Couple of applications get processed ahead of others etc., They are not sure what kind of problem they are going to face when they free everybody and let people jump companies. So, anybody in a responsible position can not act in a hurry and then burn their hands. So, they take time to think things. For us it may look simple, because, we think only about our case which we think is straight forward. Just look at the postings on this board and you will see hundreds of different scenarios. Decision makers at INS have to get many approvals, and answer many questions before they can arrive at a decision. In this country, if you screw up something, you will be held responsible. So everyone takes their time to decide. So is INS. They may still screw things up but they did try to minimize the problems.

Wow - you are one INS fan. what can I say. I can understand the issues involved but there is got to be a better way.

It may not be a bad idea. You would think that H1B guys would be printing themselves GC but legal immigrants are much more careful atleast in their Pre GC days. If the IRS can employ them, why cant the INS?
The intent of ACTA seems good. If INS cannot deliver in 6 months, let us go. But then somebody had to do .....

I am not an INS fan. I have been waiting for GC from 96. I have frustrations like everybody. But I am trying to be practical. Yes, there is a better way for everything. Everyone could have done lot of things in a better way if they think about it now. You could have done better in the past, you could have applied in EB1, you could have moved to some other country and be smarter than us waiting here endlessly, EB3 people could have gotten a masters and be eligible for EB2, US governament could have had a better voting system that does not create confusions as it did, Clinton could have divorced Hilary and married Monica quickly to avoid getting caught, Car manufacturers could have tried better in the past to implement pollution free cars so that we do not face El-Nino or whatever environmental problems we have, They could have built a better Nuclear power plant to avoid that explosion in Japan and etc., Foriegners who travel to India as tourists complain that Indian governament could have done a better job in tourism department. But is it practical ?! Do we have money (left after all those politicians built palaces for themselves)?!

What you are saying is everything has to be perfect. Nothing is perfect in life. Just think about how many things in your life are perfect and you will understand. All I tried in my previous posting is reduce your anxiety by telling you how everything can not go in just the way we want it. I thought you would calm down once you understand this fact about life. My mistake........ I will try to keep quite next time.. sorry.........
