Hi Gurus
I am reading here and there on this form that "EB3 is doomed", "No processing till October", "No matter what country u r from EB3 is not gonna move", u name it all
Could some on please let me know (no links please) if I am on EB3 and PD 10/2001, not from retrogess country. DO I HAVE ANY CHANCE OR NOT

This is not a question of honesty

If your case is not approved before July 1st of this year, it won't, in all likelihood, be approved till after Oct 1st 2005.
BTW, what is your 485 RD/ND ??

EB3 numbers are unavailable starting July 1 and its very unlikely that it'll suddenly become available during the last quarter. So if you miss the boat, the next boat would arrive on or after Oct 1st.

This is true for all EB3s (except if you are freakin' nurse) - all countries.

My situation is similar to yours
Im NSC, PD 09/2001 ND 09/2003, FP 03/06/2005, LUD 06/06/2005
Im NOT from a retrogression affected country.

Honestly I do not have any hope that my case will be approved before the end of June and I'm trying to make up my mind to add another 3 months to this desperate wait.

A week ago I was the happiest person on earth specially because the latest processing dates report from NSC, but everything changed when the DOL report came out anouncing the unavailavility of visas, now I feel humiliated and cheated.

I know I'm wrong with what I'm going to say and I apologize to all of you in advance but it drives me crazy see people getting approved with ND of 2004 and PD of 2003, there is absolutely no justice and rationale at all on how NSC adjudicates cases.

I'll suggest you... try to make up your mind.. I know it is hard but we really have no other choice... do we?

No that is not correct ... AllMighty has no powers here ... he has become AllWeak and worst of all he cannot send emails.... we may have to revist our route to success with this GC using a different path..

These days Almighty is not interested in EB3 cases. He is focusing more on the Nurses and Physiotherapists.

I'm with Ecuelloro. No matter its EB3 or EB2. They have to process first come first serve. Ofcourse if ask NSC they will say that old cases struck at Name check or FBI check. Its all Bull S....

2004 cases are getting approved and 2001 and 2002 cases are still there. God bless this NSC. Even though I'm 2003 batch, I would wish for 2001 and 2002.

But no way to clean this system.

On my case RFE was issued on June 13, I have not received it yet though. Any idea what are they going to do with RFE issued cases?

Same as any other EB3 case ....

if you are lucky, you'll get a decision before the end of the month. Once it becomes July 1st and if your case is still pending, it'll wait on EB3 availability (presumably till Oct 1st)
