What is the right time period to renew EAD?

Friends,

My 2nd-EAD is expiring mid of August this year. Last time when I got my EAD, it was a neck to neck to situation, I recieved the card only 3 days before actually my previous EAD expired.

Now, I wanted to avoid that situation and want to apply well in advance.

My attorney says that applying 90 days before it expires is good enough, indigating that I can always get EAD from the local office if do not get that on time.

It looks like getting EAD in 3 months seems to be very tough in today's scenario, what is the best time that I should give before applying for the next EAD, based on your experience?

Thanks for your insight and input.

Regards,

CokeTin

If I were you I would just apply online just around 95 days so as, if I do not recieve EAD in time, I would have a chance to go to local office requesting for a interim EAD, as adviced by your attorney. Before you delay in applying, also check with your local office, not all local offices issue interim EAD.
If you apply as early as 5 - 6 month, you may loose money if you get your 485 approved, but nothing wrong being cautious.

My spouse's EAD got approved today 03/08/04 in 33 days. I would say it is always better to apply 100 days before expiry, so atleast you can get an interim EAD at a local office. Also, these days local office's are not issuing EADs same day. Better apply 100 days before expiry.

My Spouse EAD renewal details:

RD/ND: 02/04/04
AD: 03/08/04

Thanks

I'm not sure....

I don't know if ASAP would be the way I would pick. I just renewed my EAD, it took NSC 7 weeks to process and mail the card. Since the card arrived prior to expiration day, its start date is the following day of the first one, and is good for one year. so I maintain my 3/18 renewal date.
I think you attorney is right. You don't have to rush it.
of coure you can apply 6 months ahead of time, if you choose to.

Whatever you do, good luck!!!

Thanks for your time and suggestions.

So, if I apply today, and NSC processes and send me the EAD, will

a) the start and expiry date will follow my previous EAD's expiry day

or

b) the start and expiry date will be the date they processed my case + 1 year.

Basically, I wanted to see if I am overlaping my EAD card validity dates.

CokeTin.

I don't know if INS is consistent or not but my third EAD was approved 3 months before my second EAD was expired and is valid from the expiration date of my second EAD.

Prior to Oct 2003 people reported the 2nd and 3rd EAD's had a validity from the date of issue but not from the date of last EAD expiry.
My EAD was renewed in Oct 2003, and the validity was from the expiry of the previous EAD. I think NSC has not changed its procedure.

Thanks

Thanks!!

I will goahead with renewal, I am not going to wait.

Any way with the current trend, looks like I may even get to 4th EAD.

Raghu.

When I applied for EAD, I got EAD with starting date as current processing date, which was before the expiration date of my previous EAD date ( 4 months ).

I applied for my 2nd EAD. RD and ND was 01/23 and it got approved on 03/05. My wife's RD and ND were also the same and hers got approved on 03/08. We haven't got the cards yet. Our 1st EADs are expiring on 04/30/04.

Blinkingstar,

Did you apply for your EAD before OCT 2003?

I noticed that peace_of_mind applied in OCT 2003 and got the validity date as the next day of his previous EAD expiry day, not the processing date.

Please clarify.

Thanks.

CokeTin... your att. is right ... apply atleast before 100-110 days, so in case it does not get approved you will have enough time to plan to go to local district office to get the IEAD, before your current one expires ..
