what is the benefit for us (EB2/EB3 retro) if CIR gets passed?

I am kinda out of the loop and will appreciate for any leads/comments. :confused:

I think there was only 2 major items for Employment based category in the previous CIR bill (Don't know what's there in the latest CIR/STRIVE Act)

1. Not to count the dependents for Visa #'s
2. Recapture 290,000 unused visas

If only item 1 is passed then there won't be any big relief to EB3/2 but if item 2 is passed then all countries including India may become current (depends if all visa are alloted in one go or if it is phased in # of years)

BTW, let say if the bill passes and the President signs the bill in Aug 2007, when will this take effect at USCIS/DOL. In Sept 2007 itself?

Do not forget that CIS will issue the visas after issuing them to the 20+ million illegals

It is too early to speculate about STRIVE 2007 (CIR 2007) until the text available. However, www.immigration-law.com reported as follow (per Oh law firm, it may not be good for legal immigrants like last year CIR).

03/21/2007: House Version Immigration Reform Bill Poised to be Introduced Shortly

* A bi-partisan House bill led by Rep. Gutierrez is expected to be introduced shortly. The details have yet to be disclosed. When it comes to illegal immigration reform, this bill apparently mirrors the last year's CIR. As for the legal immigration including visa number adjustment, it may not be as broad and favorable as the CIR which was passed in the Senate last year. Please stay tuned.

What about legals who have been here for 6+ years before 2006, and kept waiting thru no fault of ours?
Why can't we get immediate citizenship??
we have to be satisfied with some small increase in visa numbers! forget about the endless waits in DOL and CIS and FBI name checks!!
and how many thousands of dollars have we spent on these govt agencies? at least 5 times $2000 fine.

How unfair is this bill?!

seems like Bill Gates hearing was all in vain :(

We could have become illegal, not wasted money on attorneys, changed employers whenever we wished, had our spouses work, and we would be in the same boat as we are today

that's what I was telling from the very beginning. But you gotta realize, it's all about hispanic votes.

Item 1 would make a big difference, because that would effectively double the number of EB green cards available. Right now with dependents being counted, only about 50,000-70,000 actual workers can be approved per year; the rest of the 140,000 is taken up by spouses and children.

There aren't as many as 290K unused visas to recapture. The 290K number being thrown around was for increasing the 140K quota to 290K.

When I was waiting my labor certification, I talked to the director of the Northwest DOL. He told me the whole story on how the EB3 folks got literally screwed thanks to the 245(i) amnesty. As you are likely aware by now, he said that immigration officials back then made clear that a massive number of applications for illegals would sink the EB3 folks. Since all politicians want is to gain votes and benefit from this, they went ahead and managed to let illegals apply for 245(i) following a "queue". Yes, eventually illegals got in the queue and hurt many of us. I guess that if such amnesty is ever granted, the government will try to show also that they are doing some type of enforcement. I guess that means that illegals already here should apply and receive a type of work authorization until they become eligible to file I-485. Let's see, between 20+ million potential voters and 300K EB3/EB2 educated people who are paying taxes, which group would you give priority to? You figure out.

Since then I have been outraged by this. I think if one needs to lobby for something, it should be against this type of behavior. If such amnesty is ever granted, you can expect people faking documents and applying anyway. There is no such thing as "amnesty only for people who have been in the country for X number of years". Remember that they are illegals and there are no records indicating how long they have been here. It is so easy to print and fake whatever you want these days. Back to the 1980 amnesty, I understand there were 1 million fraudulent cases. Using modern printing equipment available at any Kinko store, I wonder how many million fraudulent cases would be submitted to USCIS. Moreover, how can USCIS screen documents for 20 million applicants anyway? Based on the number of people I see arriving every week in my neighborhood church, I'd say that I believe that there are definitely more than 20 million here.

I am following this closely lately because I have a dear friend of mine who got tired and may abandon her EB3 application. This greencard situation is disgusting.

I agree. This is sad. Let's wait for the bill to get introduced today. Unfortunately, if all they do is stop counting spouses and perhaps recapture upto 290K visas (which as someone said may not be there to recapture), our wait times will be cut in half, but will still remain significant. Of course, if no bill goes to the President, we will be worse off.

The senate this time seems to be unwilling to pass a bill, unlike last time. I wonder what is the reason for that.

I finally find somebody who uses the 20+ million of illegals.

You are right, the illegals will fake documents as easy as they did it it in 1986 when Reagan's amnesty.
