What is the age when children's cases "age out"?

But, CSPA prevents children from aging out for most of cases,
so USCIS doesn't expedite adjudication recently.

Can anyone advise, Has son aged out?


1. My husband filed I 485's for himself and youngest son feb 2002
on this form my husband indicated that myself and other child (as resident in UK at the time) file in the UK

Other child was under 21 at the time and was in the middle of a degree

2. advised to submit 2 x I 824's for myself and son, this was done before his 21st birthday, came back declined but said re-send once I 485 approved


3. I 485 for husband and youngest approved 13th April 2004


I shall do another I 824 to ask for further action on an approved petition, but do I need to also file I 130 ?

Hope somone can advise, been to variuos attornies even Congressman Weldon
