What is my status?

I had applied for an H1visa last year while on OPT (expired Feb10,2006), however it was denied on June 21st on the grounds that I had not responded to a query. Since I have documentary evidence to prove that I had responded in time Ihave filed for a motion to reopen. Can anyone tell me if my status here is legal while I wait for a decision on my appeal.

Yes. If your appeal is rejected then you are over stayed from Feb 10, 2006 which is more than 6 months, you may be barred to enter US for several years. Be cautious.
