I got an 2.5 Year H1 Visa on may 2000.
As it was expiring on Nov 2002, I asked my comapny to renew it.
They applied for renewal in August 2002. I got some questions on that, They replied for that and Now INS is taking time. I have a EAC Number. But my old visa has been expired. So if I am staying here and working, How legal it is?
 
Perfectly legal. H1B can continue working as long as the employer has filed an extension.

My I94 also got expired. If I get an extension , does this mean It is an extension of I94 also?

I didn't change my company.
 
You're in status as long as the extension is file in timely manner (before the original H1B status expires). There is a limit of 240 days that should be enough time for INS to process this type of cases. With the renewal you will get a new I94 with the new dates corresponding with the H1b renewal. I'm in he same boat.
 
How to extend Driver's License when h1b extension pending?

Hi, I am in the same boat. My h1b will expire Jan,2003, the company just filed my extenstion early November.My problem is: my driver's license expires on the same date. How can I extend my driver's license when my old h1b expired and the new one isn't approved? Anyone has any suggestions? Where can I find the answers?

Just checked this with the lawyer. She said I can use the receipt notice along with a letter she prepared for me to show to the Motor Vehicle Dept.

driver's license renewal denied

Yesterday I went to the Motor Vehicle Department to renew my driver's license. I presented them the letter from the lawyer and the INS regulation excerpt about the 240 days grace period and argued with them for more than an hour, still, they denied the renewal, saying they only observe whatever INS issued officially. Asking me to request INS to give me a letter stating I can stay before my h1 extension got approved! They also refused to talk to my lawyer. Gosh, this is frustrating. I am going to lose my right to drive starting the day after tomorrow... Any one has any suggestions? Please help.
 
Another option - if its worth it to you - is to upgrade your case via Premium processing. At least you'll get a decision within 15 days and you can drive again - if DMV continues to hold on to its ill informed decision
 
Got Renewed Driver's license.

The attorney contacted some person in local INS who in turn contacted some one in MVD and gave the authorization for renewal of my driver's license. Thank God I got it at last. Much relieved.
