What is my current legal status?

I came to the United States with F-1 visa. I applied for asylum status and I'm still waiting for my interview as I'm still within the 5 months period. However I'm currently not studying because I'm done with my intensive English program.

My question is :

What is my current legal status in the country, is there anything I can do beside waiting at this point?

If you successfully graduated from your program, you have a 60-day grace period after you graduate, during which you are still in F1 status. After that, you have no status (i.e. you are "out of status").

You can remain in the US regardless of whether you have status or not because you have a pending asylum application.

You are in asylum processing...all you have to do is wait. I think after a certain period you can apply for a work permit.

I agree with @newacct. If you completed the intensive english program, you have 60 days from the last day of your attendance in the program. However, if you only completed a term or more in the program, you only have 15 days before the school terminated your F-1 status. Nonetheless, it depends on your school whether and when they choose to terminate you after the 15 day timeframe. Here are your options to keep your F-1 status if you still have it:
  • continue enrolling in another program in the same school (if you you completed the program and are still in 60-day grace period)
  • continue with the next term (if you have not completed the program and the school has not terminated your status)
  • transfer to another school (if you have not completed the program and the school has not terminated your status)
Otherwise, you let the grace period ends, and your F-1 status will be completed automatically (still means that you are out of status if you are still present in the U.S.) or wait until the school terminated your F-1 status for failing to continue to enroll.

I also agree with @USC2013 that you are now on pending asylum application and you can stay legally in the U.S.
