What is my Current Immigration Status

Gurus please help me.....

I would like to do my EAD Renewal and on the I765 application they ask about my current immigration status.

I am a H1b visa and i am not using my EAD

My wife H1b visa has expired and she is using her EAD

We filed for I140 and 485 concurrenly in 2003.

So are we on a Work Permit or Advanced Parole or what?
 
You are in nonimmigrant status until you use your EAD.

I am in a similar boat to you; when I have sent in my renewals, I have always written "H1-B1/adjustment to permanent residence pending" ... and have never had any troubles. But I think you HAVE to note that you are still in nonimmigrant status.

Truth is, it's a pretty bizarre "no-man's" zone, isn't it?
