What is I-129 H1B EOS vs COS

While reading the processing time, I do not understand what's difference for I-129 H1B EOS and COS. Their processing time seems to differ quite a lot.

1. Which one (EOS, COS) should I refer for H1B employer transfer processing time?

2. After Oct 2003, H1B processing fee is reduced $1000 to become $130. May I know whether the premium processing service (2 weeks for additional $1000) still applies ?

3. Does the AC21 portability clause (can start work after I-129 application submitted) during H1B transfer still in effect ? Does it end with the Oct 2003 H1B cap reduction ?

EOS= Extension of status (in same category)
COS= Change of Status (like H4 to H1B or F1 to H1 or H1 to O1 L1 to H1)

--EOS, till your employer has LCA for H1b transfer
2. After Oct 2003, H1B processing fee is reduced $1000 to become $130. May I know whether the premium processing service (2 weeks for additional $1000) still applies ?

3. Does the AC21 portability clause (can start work after I-129 application submitted) during H1B transfer still in effect? Does it end with the Oct 2003 H1B cap reduction ?
--- It is in effect, you should send H1 transfer papers to BCIS once you get the receipt notice you can join new employer. Before receiving the receipt of filing if any RFE then it may create problem in future. Your lawyer knows what to do.

Based on what you explained about EOS vs COS, I am surprised to see that actually H1B transfer takes longer than those changing from F1 etc to H1B. Isn't it supposed to be the other way round ?

----- Write to your congressman or send complaint to BCIS. So many things are “supposed to be” fast but are not, sorry I cant do anything
