what is happening to our cases

dear all,
I have been reading this forum for a long long time.
My husband and I have been waiting for over30 months for the I-485 approval and we are still waiting. :(

It is such a frustrating process and I have never heard any one who has to wait as long as we do.
My husband filed his 485 in October 2001. (I filed mine several months later as his dependent)
Both of us got FP in 2002 and I was requested to do my second FP several months ago.
He got one rfe in Dec 2002. But since his first rfe, he never received any request (either FP or rfe).
This overlong process has started to influence our normal life coze both of us are very frustrated....
Does anyone has any thoughts about what is happening on our cases? Or any suggestion about what should we do? Many many thanks.

Hi Tina,

Did you make inquery to CSC or write letter to senator about your case, I think that will help you because your case already passed the JIT 30 and 60 days.
 
You should contact your local politician. A member of congress may be contacted by you directly or by your sponsor (employer).

I suggest you ask your employer to write a letter to your local congressman requesting his/her assistance. It worked in my case! (Make sure you clearly state your situation.) Our congressman contacted CSC and we were approved with 6 days.

In your case, hopefully, this will trigger a RFE or direct approval.

Also, contact your attorney. If you don't have one -- you might want to get one! You're very close. Don't give up.

Thanks for your reply. We have made several phone calls to the BCIS. But it doesn't help much because they don't have any more information about our case and just told us to wait.
As to writing to the congressman, the tricky thing is that we don't live in CA. My husband file the case here because of his company. Therefore, we are not sure whether the congressman of CA would care about our case. :(

We do have an attorney. They also told us that they couldn't get any more information. The very last time we contacted our attorney, we are told that the ins are doing security checks on our cases. We are just the most common couple in the world. Really don't know what they are checking about. :(

I would say you should write to both the CA and your area senators and congressmen, it won't hurt anything and might help you.

Another solution is wait to see the result of the hearing on June 3rd, if Rajiv won the case, then you can file a law issue. (Actually, I believe a lot of people will file law issues if that's the case )
 
I donot know why you have waited so long to contact congressmen, since your husband's case is many months before the JIT date. Remember at the most congressmen won't do anything, but it won't spoil your case. Contact congressmen/senators in CA and in your local area. Also try sending fax enquiry to CSC. Looks like that is more effective than just calling BCIS and talking to customer service person. If you do any or all of these, you should see your approval in a month!

Normally you should get the decision within 1-3 months after CIS received the RFE response. What's the last I485 status you and your husband have now? Make sure that they received the RFE. Ask your attorney to pursue this case. If you are waiting more than one year after replying RFE, there is something really wrong. What was the RFE about?

My husband's last status was " your response to our RFE was recieved in Dec, 2002. IT takes 730days for..."
My last status was " your second FP was received in Jan 2004,...."

His RFE was about: 1, employment status; 2,medical

our attorney has sent 4 fax inquires but receive no response.

Hi, tinasmile666,
I recommend you to visit the district office of Congressperson in your area and talk directly to an immigration caseworker who should request your status check to the CSC.
Usually, Congressperson provides such a service only to those who lives in her/his district area.

In my impression, most of 2001 cases not approved are stuck in the name check.

Try this also just in case name check is still to be cleared: Contact FBI and ask them to hasten it. (Search the forum for phone number) Once you have name check cleared then you can ask CIS to adjudicate your case.

You may also make 1st level, 2nd level and Final leval Fax inquiry with strong words. Your case already passed JIT processing time. It is really frustating to see such case delays and waiting period. Some cases are getting approved without much delay (like some cases in pilot program). You should really contact the congressman or senator to expedite your case. Good luck!
 
Please go to your local congressman's office. (Take your INS receipt notices and all your current immigration stuff with you. They'll make photo copies) Clearly state your problem.


I pray for you and your husband. I remember being in your situation not too long ago. It will be a time of rejoicing when you get approved.

I am in the same situation as you are. The I-485 was filed in Nov, 2001 but it is still pending. My RFE was recieved by the BCIS about one year ago. But since then there is only endless waiting, which makes me so frustrated and hopeless.
You may contact the congressman's case worker to find out what has happened. If it is for security check (name check), and your names happen to be very common, then you and I are in the exactly same boat -- we fell into a black hole since we have very bad luck. I don't know how long we should wait. The case worker can do nothing about that since it is talking about the security. Nobody can interfere that and there is no transparent procedures we can see through. Just pray we are still alive if we can be saved from the deep black hole. There is no fairness and no logic in this field.

In my case I replied to an RFE half year ago (along with 2FP) but no changes since then. So far, any inquiry on my status (via several levels of FAX requests) produces same response - officer working on my case, without giving any details (name check, etc).

how did you find out that your case is undergo extensive name check? Fax inquiry/Senator help?
I did sent recently letter to local senator, but haven't got any response yet.
Out of curiosity, what is country of your origin? I am just trying to figure out what is the criteria of extensive name check.

Both my lawyer and the congressman's case worker helped me to figure out the current situation about my case status, but no way to help. Waiting endlessly is the only solution to me. You can just call your congressman's office and after you filled in some form to ask them to represent you then the case worker can contact the BCIS. Common names are very common in my country. I didn't do anything wrong in my life. The only big mistake my parents made was they didn't give a strange and rare name.

I do not think that my name is "common" (I would rather say pretty un-common :) ). Fact is, I do not belong to unique (or un-common) category of lucky fellows, who already got approved... :rolleyes:
 
What name check could take that long!!!???

How do they do the name check any way???

As those of us working in IT know, a database search in the worst case should never take longer than days. Ok they might need to search several goverment databases, even so, anything over a few more days just sounds unreasonable.

It would be helpful to bring this to the attention of your local senator or congressman, if a simple INS name check takes more than a few days, how do they cope with the needs of National security? If it actually doesn't take that long, but just a cover for some kind inefficiency, should that calls for improvement and clarification of the process?
 
If name check takes six months, DHS/FBI better dumps their name check system. Six months is TOO LONG to find a terrorist.
