Following are the list of documents that are listed in 221(g) document
1. All supporting documents that were submitted to CIS(legacy INS) to complete part five of the form i-129 petition for a non-immigration worker.
2. A list of all candidates petitioned by the petitioning entity at the Chennai consulate , the exact times in which they joined and worked (including the date of departure, if no longer with that entity) and their current whereabouts.
3. A detailed description of the petitioners needs for this position and how the beneficiary worker intends to address them
4. Interior and exterior photos of the principal worker at work
5. Interior and exterior photos of the principal worker at home
6. Photographs(15) of the inside and outside of the petitioners work premises
7. Interior and exterior photos(15) of the premises where the H/L worker will be deployed,
8. A list of all of the petitioner’s active projects. Identify the client and point of contact with the client, including a phone number and email address for that person, if the contract with the client is held by a third party provide names and contact information for that party as well. Do not send a batch of contracts in lieu of this documentary requirement
9. A signed letter from the beneficiary’s prospects supervisor A signed letter from the beneficiary’s prospects supervisor at the end client location to which he/she will be assigned, stating the clients intention to make use of the beneficiary’s services and explaining and nature and duration of the project to which he/she will be assigned.
10. A detailed and specific description of the internal development project to which the beneficiary will be assigned, Include a complete technical description of the project, timeline, current status, number of employees assigned to it, location of the worksite , a marketing analysis for the final product
11. A complete itinerary of services or engagements specifying the dates of each service or engagement , the names and address of agent the names and address of the actual employers and the names and address of the establishment venues or locations where the services will be performed.
12. Petitioners certified or notarized federal tax returns for the last three years
13. Original W-2 forms and pay stubs for every year that the beneficiary worker had worked in the US
14. W-2 forms and payroll records for all people employed by the petitioner
15. Explain the H/L workers 2004 earnings. Please explain any discrepancies from the minimum salary mandated by the LCA
16. A Statement from the petitioner explaining how and why the H/L workers position has been kept vacant since the time the job was offered.
