What If I485 is approved while u are out of country?

In this situation:
1. Ur AP is not valid (\'coz ur I485 is approved)!
2. The passport has not been stamped \'coz u r out of country!
Can you get into the country in such a scenario?
What is the status of the H-1 visa (if u have one)?

But why do you say that AP is not valid if your I-485 is approved? I would have thought that only when you get your passport stamped are your EAD and AP taken away from you. That way they cancel each other out.

actually, I am not sure about AP getting nullified coz of I485 approval. I have asked my lawyer and shud get back on this.

A friend\'s wife was in the same situation and
she was able to enter the country using AP.

So, it shouldn\'t be a problem.

One of my friends were visiting India and was not aware that the approval has come through by mail. Only after they got here (using AP) did they see their approval notice and got their passports stamped. This happened in the last week of August. After September 11th, the procedures may have changed at Port of entry. Please check with your attorney if you plan to visit overseas and expecting approval during your stay out of US.

Relax- I\'m just joking. I\'m sure taking the notification of your I-485 approval along with your copies of AP should let you back in. I guess just present your AP first and present I-485 approval notice only if asked.
Once you use AP, your H1 is history.
