Hello all,
It has been a while since I posted msgs here. But today I need help and advice.

It has been more than 6 mos since i filed for AOS. My RD is Oct 10th, 2001.
I am in a situation where I am getting fired cas of tussle with my boss. :(

What are my options.
What should I do.

Apply for EAD and get another job. Hopefully the company wont report anything negative to INS.

Then there is whole issue of AC21 rules not being clear but since you are in AOS stage you will be in status.

If possible get a job asap.
 
Quite a few things

First and foremost pray that you do not get a RFE and your case sails through all the way smoothly.
Second try and find a job on your EAD and try to use AC21 rule.
If not successful in the second point try to find some individual who has his own Inc., who will employ you and if and when the RFE comes, he is ready to give you a an Employment letter. Also try to arrange some paystubs with the same guy.

Can the company report anything negative? Also I am sure to get RFE, cas I applied for AOS myself, without company employment verification letter.
When can I expect my RFE/approval with the current scenario?

Your Employer cant do anything..

You are okay. When RFE comes in for Employment Verification, you will be asked to produce Employment letter, W2, Paystubs.

It really doesnt matter which employer you are with, if the Interview takes place after 180 days.

So, Don't panic about the situation... You have all the rights to leave the company. The issue of your employer reporting negative is not really a solicitated information from INS. Hence, will be given lower priority, if any. To prove you have abused the employer will be difficult/expensive to prove...

Next goal: Find a job..
