What if Employer wants to keep original I797A?

I recently transferred my H1b to a new employer. I am the first employee on H1b visa. However when employer received the approval package from the lawyer, he read the details in notice, which indicates that employer should retain the upper portion and employee should keep the lower portion (I94). I explained him, that in reality, employee keeps the original one, because one has to produce it to authorities, while travelling or applying for visa.

However I need your help, if this is the case,if anything can be done or is there anyway to convince my employer to handover the original I797A.

Tell your employer that without I-797A you will not get VISA stamped. You can also show him the document list that say I797 is required for stamping.

And yes, theoretically he can keep the upper part of I797 once you are done with stamping. You can simply make a copy of it and return.

-----------you can go to US consulate site and give him printout that H1 approval notice is needed for Visa stamping ORlet the Lawyer inform him.
