The USC files for DIVORCE after you guys have filed for the I-751? What happens then? Scenario:

You have already done the biometrics, and they accepted your stuff. No interview called.. just waiting and waiting.. say for some reason your relationship has been StRuGgLiNg I mean... s.t.r.u.g.gl.i.n.g. And then USC heads to court.. what happenz?

You will not get your green card without your spouse there at interview with you. If the marriage has broken down, your eligibility for GC, EAD etc has gone with it.

I know there are some exceptions in the case of abusive spouses which may or may not apply to your situation...

Please look for information before post. EAD is long time unnecessary and not part of a I-751.

Simple, if your divorce is NOT final and your I-751 is approved then you are good to go. If your divorce is final BEFORE your I-751 is approved, you must file a new I-751 with the divorce waiver (check the instructions on the I-751), evidence of your bona fide marriage (practically same as you did in your joint filing and/or more info) plust your divorce decree.

The bad scenario could be if you get call to an interview and if the USC refused to go with the alien. In any case the alien should go to the interview and explain the situation...for that matter, I strongly advice to get a lawyer along. The adjudicator may or many not give you a chance. If the AO decide to deny the case and put the alien in removal proceedings, still the alien can be in front of an IJ that most commonly (if you got a good lawyer and brains) will give extension until you get your divorce decree and refile a new I-751.

But seriously, I think there are loopholes in the system. And i think one could get their GC even

For the record, my marriage is not in trouble. I THINK :)

So this was something that crossed my mind and I thought of asking. There is not a way I will screw up my marriage, not at all. There is more to life than fighting your spouse.

And the have it revoked later on (when USCIS checks local courts for divorces OR he files for citizenship and shows the Divorce date and the approval of GC date).

I am sure you'd agree with some who say more information is better than less. Yah thats me right there. The excessive gatherer of information. You know what, it just crossed my mind ok:p. I am the kind pf person who if I was in trouble I'd try by all means to diffuse the problem. Never head to court or involve lawyers, its unnecessary (they will complicate the matter, make u guys hate each other more, and drag the case for months, thus making u broke more). If you have lived with a person for years and things arent working. Move away from each other "amicably". Haah

That way you can preserve your friendship and save a lot of doe.
